Resumen
Este informe jurídico analiza la Resolución Final N.º 007-2025/CC3, mediante la
cual el Indecopi sancionó a Interbank por vulnerar los deberes de información e
idoneidad tras un incidente operativo que afectó masivamente los saldos de sus
clientes. Además de imponer una multa, la Comisión ordenó como medida
correctiva complementaria la implementación de un Programa de Cumplimiento
en materia de protección al consumidor, lo cual constituye un precedente
relevante en este ámbito del derecho en el Perú.
La base normativa principal es el artículo 116 del Código de Protección y
Defensa del Consumidor, cuyo literal f) faculta a la autoridad a adoptar medidas
destinadas a evitar la reiteración de infracciones. A partir de esta habilitación, y
del Reglamento emitido en 2019 sobre programas de cumplimiento en
consumidor, se analizan los alcances de esta facultad. El análisis incorpora
además referentes comparados y técnicos —como la Norma ISO 31700:2021 y
el Consumer Compliance Examination Manual de la FDIC— junto con los riesgos
más recurrentes detectados por el propio Indecopi en sus procedimientos.
El informe concluye que la medida impuesta resulta razonable y proporcional
frente a la magnitud de la afectación. No obstante, se advierte que el marco
normativo vigente en materia de compliance para consumo aún es limitado y
carece de parámetros técnicos comparables a los desarrollados en Libre
Competencia. Por ello, se recomienda que el Indecopi elabore una guía oficial
de programas de cumplimiento que permita fortalecer una cultura preventiva en
la protección de los derechos del consumidor y establezca incentivos para el
registro e implementación de los programas de cumplimiento.
This legal report analyzes Final Resolution No. 007-2025/CC3, whereby Indecopi sanctioned Interbank for violating its duties of information and suitability following an operational incident that massively affected its customers' balances. In addition to imposing a fine, the Commission ordered the implementation of a Consumer Protection Compliance Program as a complementary corrective measure, which constitutes a relevant precedent in this area of law in Peru. The main regulatory basis is Article 116 of the Consumer Protection and Defense Code, paragraph f) of which empowers the authority to adopt measures to prevent the recurrence of violations. Based on this authorization and the 2019 Regulation on consumer compliance programs, the scope of this power is analyzed. The analysis also incorporates comparative and technical references— such as ISO 31700:2021 and the FDIC's Consumer Compliance Examination Manual—along with the most recurrent risks detected by Indecopi itself in its proceedings. The report concludes that the measure imposed is reasonable and proportionate to the magnitude of the impact. However, it notes that the current regulatory framework for consumer compliance is still limited and lacks technical parameters comparable to those developed in free competition. Therefore, it recommends that Indecopi develop an official guide to compliance programs that will strengthen a preventive culture in the protection of consumer rights and establish incentives for the registration and implementation of compliance programs.
