Abstract
La contratación pública es una de las actividades más complejas de la gestión
estatal, no solo porque representa más del 50% del gasto público en el país, sino
también por su dinámica procedimental y el riesgo latente de incurrir en
irregularidades y mala gestión, es por ello que el ejercicio del control
gubernamental tiene un papel relevante al cautelar el uso adecuado de dichos
recursos públicos, pues la función de fiscalización, más allá de tener una
connotación reactiva, debe ser proactiva y aportar significativamente a mejorar
la compra pública. Por tanto, la presente investigación tiene como objetivo
determinar si el control gubernamental externo incide en la gestión de la
contratación de bienes y servicios del Jurado Nacional de Elecciones del 2016 al
2020. La investigación es de tipo descriptiva y explicativa, asimismo, el marco
metodológico que guía la presente investigación es de tipo mixto, con predominio
del carácter cualitativo. Los resultados nos permiten concluir que el control
externo incide positivamente en la gestión de la contratación de bienes y
servicios del JNE en dicho periodo, no obstante, se ha ejecutado respetando,
parcialmente, los principios de oportunidad, materialidad y carácter selectivo del
control. Asimismo, se evidencia que el control simultáneo y posterior influye
positivamente en las distintas etapas de la contratación, aunque lo hace con
mayor énfasis en la ejecución contractual. Finalmente, las recomendaciones de
los informes de control, incluido el propio proceso de control, sí repercuten en la
toma de decisiones de los gestores de las contrataciones de bienes y servicios
en el JNE, aunque dicho impacto no necesariamente es positivo, puesto que,
debido al enfoque tradicional del control y a la percepción negativa que aún
subsiste, este no permite acompañar la toma de decisiones de los gestores y,
con frecuencia, conlleva a una toma de decisiones menos ágil.
Public procurement is one of the most complex activities of state management, not only because it represents more than 50% of public spending in the country, but also because of its procedural dynamics and the latent risk of incurring in irregularities and mismanagement, therefore the exercise of government control plays a relevant role in safeguarding the proper use of the public resources, since the oversight function, beyond having a reactive connotation, must be proactive and contribute significantly to improving public procurement. Therefore, the objective of this research is to determine if external government control affects the management of the contracting of goods and services of the National Elections Jury from 2016 to 2020. The research is descriptive and explanatory, the methodological framework that guides the present investigation is of a mixed type, with a predominance of the qualitative character. The results allow us to conclude that external control has a positive impact on the management of the contracting of goods and services of the JNE in said period, however, it has been carried out partially respecting the principles of opportunity, materiality and selective nature of the control. Likewise, it is evident that the simultaneous and subsequent control positively influences the different stages of contracting, although it does so with greater emphasis on contractual execution. Finally, the recommendations of the control reports, including the control process itself, do have an impact on the decision-making of the managers of the contracting of goods and services in the JNE, although the impact is not always positive, because of the traditional approach of the control and the negative perception that still exists about it, it does not string along with decision-making of managers and often leads to less agile decision-making.
