Informe jurídico sobre la sentencia del caso Caamaño Valle vs. España del Tribunal Europeo de Derechos Humanos

Abstract

El presente trabajo analiza la sentencia Caamaño Valle vs. España resuelta por el Tribunal Europeo de Derechos Humanos que aborda el caso M., una joven con discapacidad intelectual privada de su derecho al voto como resultado de una sentencia de incapacitación parcial. La madre de M. recurrió al Tribunal alegando que el estado español vulneró el derecho de M. de participar en elecciones libres y el principio de igualdad y no discriminación, los cuales se encuentran consagrados en el Convenio Europeo de Derechos Humanos. El Tribunal concluyó que no existió ninguna violación del Convenio en el caso ya que se trataba de una medida individualizada y dentro del margen de apreciación del Estado. A partir del desarrollo del caso, se analizará la legitimidad de la medida y la compatibilidad de la decisión del Tribunal con los estándares de los sistemas de protección en materia de derechos de personas con discapacidad. Para ello, se determinará la legitimidad del uso de la “capacidad” como justificación para restringir derechos políticos. Luego, se analizará si el Tribunal Europeo de Derechos Humanos justificó adecuadamente la medida apelando al margen de apreciación estatal, y si dicha justificación resulta compatible con el principio de no discriminación, especialmente a la luz del modelo social de discapacidad consagrado en la Convención sobre los Derechos de las Personas con Discapacidad.

This paper analyzes the Caamaño Valle vs. Spain ruling by the European Court of Human Rights. In the case M., a young woman with an intellectual disability, is deprived of her right to vote because of a partial incapacitation sentence. M.'s mother appealed to the Court alleging that the Spanish state had violated M.'s right to participate in free elections and the principle of equality and nondiscrimination enshrined in the European Convention on Human Rights. The Court concluded that there was no violation of the Convention in the case, as the measure was individualized and within the State's margin of appreciation. To begin with, this aims to assess the legitimacy of the measure and the compatibility of the Court's decision with the standards of the protection systems regarding the rights of persons with disabilities. For that, it will analyze the limits of the use of the “capacity” criterion as a justification for restricting political rights and assess whether the measure meets the criteria of legality, legitimate aim and proportionality required by the ECTHR. Second, it will analyze whether the measure constitutes a type of exclusion based on a prohibited category in accordance with the social model of disability enshrined in the Convention on the Rights of Persons with Disabilities.
