El camino hacia una industria de madera responsable: “Análisis jurídico del sistema de incentivos de la Certificación Forestal Voluntaria como herramienta para fortalecer el manejo de las Concesiones Forestales Maderables en el Perú”

Resumen
La Certificación Forestal Voluntaria (en adelante “CFV”) es una de las herramientas más
importantes para el sector forestal a nivel mundial en los últimos años. Incorporada a la legislación
peruana a inicios del milenio, tiene como propósito garantizar que las actividades de
aprovechamiento del bosque se realicen de manera sostenible. En reconocimiento de su
importancia, la presente tesis analiza desde el punto de vista jurídico el funcionamiento de esta
herramienta, las ventajas que esta presenta y el régimen de fomento consagrado para su
implementación en las actividades de manejo forestal por parte de los titulares de Concesiones
Forestales Maderables en el Perú. Mi hipótesis es que resulta necesaria una mejora en la regulación
de la CFV dentro de la legislación peruana para fortalecer el régimen de fomento aplicable.
La tesis se encuentra estructurada en cinco capítulos. El primero describe a la CFV como una
herramienta de manejo forestal sostenible dentro de la industria de madera en el Perú; el segundo
presenta un análisis de la normativa aplicable a la CFV, incluyendo al régimen de fomento; el
tercero explica cómo el fomento de la CFV puede contribuir al efectivo cumplimiento de los
compromisos internacionales celebrados por el Perú respecto a los bosques; el cuarto capítulo
contiene los resultados de las entrevistas realizadas a los principales expertos con experiencia en
CFV; y finalmente en el quinto capítulo se recopilan las conclusiones generales de la investigación,
confirmándose la hipótesis planteada.
En este punto, el último capítulo remarca la necesidad de fortalecer el régimen de fomento de la
CFV a través de la optimización de la normativa aplicable y la inclusión de mayores incentivos.
La tesis concluye con una serie de recomendaciones específicas dirigidas a los principales actores
del sector para mejorar, desde el ámbito jurídico, la promoción del sistema de CFV en las
Concesiones Forestales Maderables.
In recent times, Forest Certification has emerged as one of the most important tools for the forestry sector worldwide. This tool was incorporated first into Peruvian legislation at the beginning of the millennium with its main purpose to guarantee that forest management activities are carried out in a sustainable way. In acknowledgment of its importance, this Thesis examines Forest Certification from a legal perspective with a focus of understanding the functioning, advantages and the promotion focus regulation established by Peruvian legislation for its execution in forest management activities by the holders of Logging Concessions in Peru. My hypothesis is that peruvian current legislation related to Forest Certification requires an enhancement in order to strengthen the promotion focus regulation. The structure of the thesis is established in five chapters. Chapter one provides an overview of Forest Certification as a tool for sustainable forest management within peruvian timber industry in Peru; Chapter two reviews local regulations applicable to Forest Certification, including the promotion focus regulation; Chapter three will explain how the encouragement of Forest Certification can help Peru to fulfill its international commitments as a state related to forests; Chapter four analyzes empirical evidence collected by interviewing peruvian main experts related to Forest Certification; and, Chapter five comes up with the conclusions of the research. At this point, the last chapter highlights the need to strengthen the promotion focus regulation applicable to Forest Certification by making regulation more efficient and increasing incentives. The thesis concludes listing, from a legal input, a series of recommendations directed to the forest sector main actors in an effort to promote Forest Certification in Logging Concessions.
