Abstract
El presente informe jurídico aborda un caso judicial donde se declaró fundado un recurso
de anulación de laudo arbitral por supuestamente adolecer de vicios de motivación al no
presentar una valoración del informe de un perito cuyo objeto era afirmar las deficiencias
técnicas de un expediente técnico. Por lo cual, mediante el análisis de la doctrina,
legislación y jurisprudencia se cuestiona la decisión judicial porque los jueces emitieron
opinión sobre los criterios presentados por los árbitros para resolver el arbitraje, aún
cuando ello está prohibido bajo la Ley que norma el arbitraje. Del mismo modo, el
informe apoya la posición de que los supuestos de vicios de motivación aplicables a los
laudos arbitrales serán la inexistencia de motivación y la falta de justificación interna. Por
último, se presenta una opinión respecto a una cuestión de fondo del arbitraje: la invalidez
de la resolución contractual de una parte y una supuesta vulneración a la cosa juzgada por
el laudo arbitral.
The present legal report addresses a judicial case where an appeal to annul an arbitration award was upheld on the grounds of alleged motivational defects, as it failed to provide an assessment of an expert's report which aimed to highlight the technical deficiencies of a technical file. Therefore, through the analysis of doctrine, legislation, and jurisprudence, the judicial decision is questioned because the judges gave an opinion on the criteria presented by the arbitrators to resolve the arbitration, even though this is prohibited under the Law governing arbitration. Similarly, the report supports the position that the grounds for motivational defects applicable to arbitration awards will be the absence of motivation and the lack of internal justification. Finally, an opinion is presented regarding a substantive issue of the arbitration: the invalidity of one party's contract termination and an alleged violation of res judicata by the arbitration award.
