Resumen
El presente informe jurídico tiene como propósito realizar un análisis de la
Resolución N° 1779-2023/SPC-INDECOPI, en virtud del cual los señores
Namihas-Boza presentaron una denuncia ante el Instituto Nacional de Defensa
de la Competencia y de la Protección de la Propiedad Intelectual, en contra de
la empresa Inversiones Alfaro S.A.C., debido a una infracción a su derecho a la
información.
La relevancia del presente caso radica principalmente en analizar la naturaleza
jurídica de este derecho consagrado en la Constitución Política del Perú así
como, en el Código de Protección y Defensa al Consumidor. Ello es
especialmente importante debido a que, no contamos con un criterio
jurisprudencial uniforme por parte del citado Instituto que permita establecer qué
es relevante en el sector inmobiliario, lo cual permitió en el presente caso
declarar infundada la denuncia infringiendo aún más el derecho de los
consumidores y validando que los proveedores de productos y servicios
inmobiliarios guarden silencio frente a los obstáculos que estuvieran dilatando el
saneamiento de la propiedad.
A efectos de poder analizar la Resolución anteriormente mencionada,
discutiremos si constituye una obligación de los proveedores de productos y
servicios inmobiliarios, informar acerca de ello, así como si ostenta el carácter
de información relevante. Sin perjuicio de lo anterior, para llegar a responder
estas importantes preguntas primero analizaremos los tipos de infracciones
administrativas, los criterios jurisprudenciales de la entidad competente, la
naturaleza de este derecho y la responsabilidad de los gerentes generales a
título personal por la infracción dolosa al derecho a la información.
The purpose of the this legal report is to analyse Resolution No. 1779-2023/SCPINDECOPI under which Mr. Namihas and Ms. Boza filed a complaint with the National Institute for the Defense of Competition and the Protection of Intellectual Property, against the company Inversiones Alfaro S.A.C. due to an infringement of its right to information. The relevance of this case lies mainly in analysing the legal nature of this right, which is enshrined in the Peruvian Political Constitution and the Consumer Protection and Defence Code. This is particularly important because we do not have a uniform jurisprudential approach on the part that Institute to establish what the real estate sector is. This allowed in the present case to declare the complaint unfounded, further infringing the right of consumers and validating that suppliers of real estate products and services should remain silent in the face of obstacles that were delaying the restoration property. For the purpose of analysing the aforementioned Resolution, we will discuss whether it constitutes an obligation of providers of real estate products and services to inform about it, as well as if it has the character of relevant information. Without prejudice to the foregoing in order to arrive at answers to these important question we will first analyse the types of administrative infringements, the jurisprudential criteria of the competent authority, the nature of this right and the liability of general managers in their personal capacity for a wilful infringement of the right to information.
