Resumen
La interpretación del delito de colusión ha generado debates, especialmente
respecto del bien jurídico protegido y la relación entre el primer y segundo párrafo
del artículo 384 del Código Penal. La Casación N.º 542-2017-Lambayeque
constituye un precedente en esta discusión.
En este trabajo, luego de la revisión doctrinaria, jurisprudencial y normativa
nacional e internacional, se concluye que el delito de colusión simple protege la
imparcialidad en el marco de la contratación pública puesto que permite una
persecución más eficaz y cuenta con sustento constitucional, así como
convencional.
La colusión agravada es un tipo penal pluriofensivo puesto que tutela la
imparcialidad y el patrimonio estatal. Así, es imprescindible que se ocasione un
perjuicio patrimonial al Estado para que este tipo penal se consume.
Además, se establece, luego de realizar una interpretación teleológica, que la
relación entre el delito de colusión simple y agravada es la de tipo base y
derivado. Ambos comparten el elemento esencial de la concertación y se
distinguen en si esta causa daño al patrimonio del Estado o no.
Concluir que la relación entre ambos párrafos es esta resulta útil puesto que
incide en la determinación judicial de la pena. En consecuencia, el sistema a
emplear es el escalonado.
The interpretation of the crime of collusion has generated debates, particularly regarding the protected legal interest and the relationship between the first and second paragraphs of Article 384 of the Criminal Code. Cassation No. 542-2017- Lambayeque constitutes a precedent in this discussion. This paper, after a review of doctrinal, jurisprudence and national and international regulation, concludes that the crime of simple collusion protects impartiality within the framework of public procurement. This position is based on it allows a more effective prosecution. Also, it is supported by constitutional principles and international legal standards. Aggravated collusion is a multi-offensive crime because it protects impartiality within the framework of public procurement and state assets. Therefore, it is indispensable that it causes economic damage to state assets. Moreover, based on a teleological interpretation, it concludes that the relationship between the crime of simple collusion and aggravated collusion is from base type to derivative offense. They both share the essential element of collusive agreement, and they are distinguished by whether there is damage to state assets. Concluding that the relationship between the two paragraphs is as described is useful because it impacts the judicial determination of the penalty. Consequently, the applicable system is the tiered one.
