Abstract
El objeto principal de este informe es analizar los fundamentos de la sentencia
recaída en el Expediente 00008-2022-PI/TC en donde el Tribunal Constitucional
confirma la constitucionalidad de la Ley No 31520. Aquí cabe acotar que esta
acción de inconstitucionalidad es presentada por una facción de parlamentarios
que consideran que la normativa vulnera el derecho a la educación de calidad;
no obstante, son los mismos que impulsaron esta ley en el íter legislativo. Esta
particularidad será estudiada en el presente informe.
De la misma manera, se tomará en cuenta el uso de la jurisprudencia más
relevante en materia de educación superior, como es la STC 00017-2008/PI-TC,
doctrina perteneciente al derecho procesal constitucional e instrumentos
normativos importantes en la materia como el Pacto Internacional de Derechos
Económicos, Sociales y Culturales, para tener estándares claros respecto a lo
que significa el derecho a una educación de calidad.
Después de un análisis de los enunciados normativos de la Ley en cuestión, se
procederá a concluir que se da una infracción total a la Constitución al vulnerar
el derecho a la educación de calidad al restar independencia al órgano de control
exterior de la calidad universitaria, el derecho a un juez imparcial e
independiente, el principio de separación de poderes y competencia, y parte del
bloque de constitucionalidad.
The main purpose of this work is analyzing the arguments of the sentence 00008- 2022-PI/TC where the Constitutional Court confirms the constitutionality of Law No. 31520. Here it should be noted that this unconstitutionality action is presented by a faction of congressman who consider that the regulations violate the right to quality education; however, they are the same ones that promoted this law in the legislative sphere. This particularity will be studied in this text. In the same way, the use of the most relevant jurisprudence in the field of higher education will be studied, such as STC 00017-2008/PI-TC, doctrine belonging to constitutional procedural law and important international instruments, such as the Pact International on Economic, Social and Cultural Rights. After a detailed analysis of the Law, this text concludes that there is a total violation of the Constitution by violating the right to quality education by reducing the independence of the external control institution for university quality, the right to an impartial and independent judge, the principle of separation of powers and competence, and part of the constitutional block.
