Resumen
El presente informe expone y desarrolla diversos problemas contenidos en la Resolución
Nº 246-2018/SPC-INDECOPI, la cual sanciona la conducta de un proveedor que
comercializó un balón de GLP con una válvula defectuosa, lo cual produjo una explosión
en el restaurante del denunciante o comprador. Ante ello, la Comisión del INDECOPI
declaró infundada la denuncia al considerar que no se había acreditado una infracción
al deber de idoneidad (artículos 18º y 19º). Sin embargo, la Sala anuló parcialmente
dicha decisión afirmando que la infracción cometida en este caso se refería al deber
general de seguridad (artículo 25º) y, en vía de integración, declaró fundada la denuncia.
En tal sentido, podemos apreciar tres debates centrales: primero, si la entrega de un
producto defectuoso configura una falta al deber de idoneidad o una vulneración al deber
general de seguridad; segundo, si la microempresa (o el restaurante) puede formular
una denuncia ante el INDECOPI o si califica como consumidor para tales efectos;
finalmente, si la Sala respetó el debido procedimiento al modificar la imputación original
en vía de integración. El caso permite, en suma, analizar el alcance de la
responsabilidad de proveedores en productos de alto riesgo, así como las garantías
esenciales del procedimiento administrativo sancionador.
This report exposes and develops various legal issues addressed in Resolution No. 246- 2018/SPC-INDECOPI, which sanctioned the conduct of a supplier for commercializing an LPG cylinder with a defective valve, an event that resulted in an explosion at the restaurant of the complainant or purchaser. Consequently, the INDECOPI Commission declared the complaint unfounded on the grounds that a violation of the duty of suitability had not been proven (Articles 18 and 19). However, the Chamber partially annulled that decision, holding that the infringement in this case concerned the general duty of safety (Article 25) and, by way of integration, declared the complaint well founded. In this regard, three central debates arise: first, whether the delivery of a defective product constitutes a breach of the duty of suitability or a violation of the general duty of safety; second, whether the microenterprise (or restaurant) is entitled to file a complaint before INDECOPI or qualifies as a final consumer for such purposes; and finally, whether the Chamber respected due process by modifying the original charge through the process of integration. Overall, the case allows for an analysis of the scope of suppliers’ liability in relation to high-risk products, as well as the essential guarantees of the administrative sanctioning procedure.
