Resumen
Según la Constitución Política de 1993, el Perú opera conforme al régimen de economía social de mercado,
modelo económico bajo el cual priman las libertades individuales tales como la libre iniciativa privada y la
libertad de empresa, así como el principio de subsidiariedad, garantía que limita la intervención de la
Administración Pública en el mercado como competidor. Así, ante la realización de actividad empresarial
estatal, el Indecopi es la entidad competente para fiscalizar dicha actividad puesto que, a través de esta,
se puede incurrir en actos de competencia desleal si no se ha ejecutado conforme a las exigencias del
artículo 60 de la Constitución.
En tal sentido, el presente Informe tiene la finalidad de analizar si, en el contexto del Expediente N° 169-
2008/CCD, el servicio de salud bajo tarifario diferenciado provisto por el Hospital Nacional Cayetano
Heredia se trata de una actividad empresarial y si se realizó conforme a las disposiciones constitucionales.
Dicho procedimiento resulta relevante pues trae a colación el debate sobre el rol subsidiario del Estado en
la economía, más aún cuando se trata de una prestación de servicios de salud, actividad habitualmente
asistencial.
Para ello, se evalúan los hechos relevantes, las condiciones del servicio brindado por la imputada, la
normativa aplicable, la metodología empleada por el Indecopi para la resolución de dichas controversias y
como puede resultar insuficiente para el análisis de prestaciones consideradas como asistenciales a
primera vista, todo ello a través de un análisis multidisciplinario de diversas ramas jurídicas.
Así, concluimos que la participación estatal en el mercado supone una lesión a las libertades individuales
protegidas por la Constitución, por lo que debe ser permitida únicamente bajo supuestos excepcionales.
No obstante, la prestación de salud efectuada por el Hospital bajo un tarifario diferenciado incumple con los
requisitos constitucionales establecidos por lo que deviene en ilícita.
According to the Political Constitution of 1993, Peru operates under the social market economy regime, an economic model under which individual freedoms such as free private initiative and freedom of enterprise prevail, as well as the principle of subsidiarity, a guarantee that limits the intervention of the Public Administration in the market as a competitor. Thus, when carrying out state business activity, Indecopi is the competent entity to supervise such activity since, through it, acts of unfair competition may be incurred if it has not been carried out in accordance with the requirements of Article 60 of the Constitution. In this regard, the purpose of this Report is to analyze whether, in the context of Case No. 169-2008/CCD, the health service provided by the Cayetano Heredia Hospital under a differentiated tariff is a business activity and whether it was carried out in accordance with constitutional provisions. This procedure is relevant because it brings up the debate on the subsidiary role of the State in the economy, even more so when it comes to the provision of health services, which is usually an assistance activity. For this purpose, we evaluate the relevant facts, the conditions of the service provided by the defendant, the applicable regulations, the methodology used by Indecopi for the resolution of such disputes and how it may be insufficient for the analysis of benefits considered as assistance at first sight, all this through a multidisciplinary analysis of various legal branches. Thus, we conclude that state participation in the market is a violation of individual freedoms protected by the Constitution and should therefore be allowed only under exceptional circumstances. However, the provision of health care by the Hospital under a differentiated tariff does not comply with the established constitutional requirements and is therefore unlawful.
