Resumen
En vista al constante avance de la tecnología de los Smart Contracts en un
mundo globalizado, la reducida investigación sobre el tema a pesar de las dudas
existentes sobre su legalidad y, sobre todo, la falta de regulación sobre las
mismas, en el presente trabajo, se analizará los Smart Contracts generados en
la cadena de bloques de Ethereum bajo la noción tradicional del contrato. Dicho
análisis se realizará de acuerdo a la legislatura civil peruana y la doctrina
correspondiente, con el objetivo de responder la interrogante de si estos, como
conjunto, son contratos jurídicamente relevantes. Se trata de una investigación
que analiza estudios realizados sobre los Smart Contracts, Ethereum, la
tecnología relacionada, así como la legislación y doctrina pertinentes
(investigación documental). Siendo así, al final del trabajo, lograremos concluir
que estos Smart Contracts pueden ser contratos jurídicamente relevantes
cuando concurran todos los elementos del contrato.
Given the constant advancement of smart contract technology in a globalized world, the limited research on the topic despite existing doubts about its legality and, above all, the lack of regulation in our country, this thesis will analyze smart contracts generated on the Ethereum blockchain under the traditional notion of a contract. This analysis will be conducted in accordance with Peruvian civil legislation and corresponding doctrine, with the aim of answering the question of whether these, as a whole, are legally enforced contracts. This research analyzes previous studies conducted on smart contracts, Ethereum, related technology, as well as relevant legislation and doctrine (documentary research). Thus, at the end of this paper, we will conclude that these smart contracts can be legally relevant contracts when every element of a legal contract is present.
