Informe jurídico sobre Resolución N° 0168-2023/SPC-INDECOPI

Abstract

La Resolución Final N° 0168-2023/SPC-INDECOPI, emitida por la Sala Especializada en Protección al Consumidor, gira en torno al procedimiento administrativo sancionador iniciado contra Autoplan Empresa Administradora de Fondos Colectivos S.A. a raíz de la denuncia administrativa presentada por la señora Leydi Gladys Jiménez Méndez. Las imputaciones plasmadas dentro de la resolución corresponden a presuntas infracciones al deber de información y al uso de métodos comerciales agresivos o engañosos, ambas conductas tipificadas en los artículos 1.1° y 58.1° del Código de Protección y Defensa del Consumidor. La Sala decidió revocar la sanción por infracción al 1.1° interpuesta en primera instancia y confirmar la sanción por infracción al 58.1°. Para emitir el fallo, la Sala se apoyó en analizar la información brindada por Autoplan durante la etapa precontractual, tanto de forma escrita como verbal. En este informe se buscará demostrar que el análisis de la Sala resulta insuficiente e incongruente. Con ese fin nos apoyaremos en la doctrina, jurisprudencia y el contenido del propio Código de Protección y Defensa del Consumidor para establecer el contenido y alcance de los conceptos vinculados al deber de información y los métodos comerciales engañosos.

Final Resolution N° 0168-2023/SPC-INDECOPI, issued by the Specialized Chamber on Consumer Protection, deals with the administrative sanctioning procedure initiated against Autoplan Empresa Administradora de Fondos Colectivos S.A. as a result of the administrative complaint filed by Mrs. Leydi Gladys Jimenez Mendez. The charges set forth in the resolution correspond to alleged violations to the duty of information and the use of aggressive or misleading commercial methods, both conducts typified in articles 1.1° and 58.1° of the Code of Consumer Protection and Defense. The Chamber decided to revoke the sanction for infringement of article 1.1° filed in the first instance and to confirm the sanction for infringement of article 58.1°. In order to issue its decision, the Chamber relied on the analysis of the information provided by Autoplan during the pre-contractual stage, both in written and verbal form. This report will seek to demonstrate that the Chamber's analysis is insufficient and inconsistent. To this end, we will rely on doctrine, jurisprudence and the contents of the Consumer Protection and Defense Code itself to establish the content and scope of the concepts related to the duty of information and misleading commercial methods.
