Resumen
En el presente informe se analizará jurídicamente la Resolución N.° 0164-
2023/SEL INDECOPI recaída en el Expediente N.° 000134-2022/CEB, respecto a
la potencial imposición de una barrera burocrática ilegal y/o carente de
razonabilidad por parte de la Municipalidad Distrital de Miraflores,
fundamentalmente materializada en la Ordenanza 554-MM, debido a que en dicha
norma se establece la exigencia de presentar una autorización de uso de
infraestructura de terceros para mantener instalada una infraestructura de
telecomunicaciones (cableado aéreo).
Para cumplir dicha finalidad, se recurrirá a diversas instituciones del Derecho
Administrativo para determinar la potestad del INDECOPI respecto del control a la
potestad reguladora municipal (específicamente sobre el tendido e instalación de
infraestructura aérea para el servicio de telecomunicaciones en espacios públicos).
Por ello, se desarrollará el procedimiento para determinar la legalidad de la
exigencia cuestionada, y los efectos de las decisiones del INDECOPI sobre las
disposiciones emitidas por los gobiernos locales. Asimismo, se examinarán los
conceptos de descentralización y competencias compartidas, a fin de comprender
los límites normativos y funcionales que enfrentan las municipalidades cuando
regulan sectores estratégicos como las telecomunicaciones, especialmente a la luz
de la Ley N.° 29022 y de los criterios establecidos por la Sala Especializada en
Eliminación de Barreras Burocráticas de dicha entidad.
Finalmente, se analizará los límites a valores constitucionales como el orden y la
seguridad (cuya protección, nuestro ordenamiento jurídico le encarga a las
municipalidades) que provienen de la necesidad de expandir y fortalecer la
infraestructura en telecomunicaciones cuya regulación a través de la Ley N.° 29022
considera que dicho servicio no solo es de interés y necesidad pública, sino que
constituye la base fundamental para la integración y el desarrollo social y
económico del país.
This report will legally analyze Resolution No. 0164-2023/SEL INDECOPI issued in File No. 000134-2022/CEB, regarding the potential imposition of an illegal and/or unreasonable bureaucratic barrier by the District Municipality of Miraflores, fundamentally materialized in Ordinance 554-MM, because in said regulation the requirement to present an authorization for the use of third-party infrastructure to maintain an installed telecommunications infrastructure (aerial cabling). To achieve this objective, various institutions of Administrative Law will be used to determine INDECOPI's authority to oversee municipal regulatory powers (specifically regarding the installation of aerial telecommunications infrastructure in public spaces). Therefore, the procedure for determining the legality of the challenged requirement and the effects of INDECOPI's decisions on regulations issued by local governments will be developed. Likewise, the concepts of decentralization and shared powers will be examined to understand the regulatory and functional limitations faced by municipalities when regulating strategic sectors such as telecommunications, especially in light of Law No. 29022 and the criteria established by INDECOPI's Specialized Chamber for the Elimination of Bureaucratic Barriers. Finally, the limits to constitutional values such as order and security (whose protection our legal system entrusts to the municipalities) will be analyzed, limits that arise from the need to expand and strengthen the telecommunications infrastructure, whose regulation through Law No. 29022 considers that this service is not only of public interest and necessity but also constitutes the fundamental basis for the integration and social and economic development of the country.
