El lenguaje claro para lograr el encuentro comunicativo entre la justicia y el ciudadano en el Perú

Abstract

El lenguaje de la justicia se ha caracterizado por ser impenetrable: sus giros arcaicos, latinismos, tecnicismos, circunloquios, palabras complejas y oraciones llenas de subordinadas impiden la comprensión y obligan a recurrir a un “traductor”. En este trabajo proponemos la aplicación del lenguaje claro para lograr que el juez se dirija a la persona involucrada en el proceso como al principal destinatario de su mensaje, un ciudadano que tiene derecho a comprender. Que su lenguaje permita que se acerque al ciudadano al que afectará su sentencia y no, por el contrario, recalque las diferencias entre ambos y los distancie. Para ello, hemos detectado las contravenciones a las pautas del lenguaje claro en pasajes de sentencias reales para, posteriormente, proponer una nueva redacción, simple y comprensible. También hemos recurrido a entrevistas con diferentes profesionales involucrados en el mundo de la justicia —un juez, una lingüista judicial, un ex secretario de la JNJ, el coordinador de Gobierno Abierto de la PCM y la representante de la principal propulsora de la Red Peruana de Lenguaje Claro Oficial— para que nos ayuden a entender el estado del lenguaje claro y la justicia en el Perú de hoy. Asimismo, proponemos una serie de lineamientos a cargo de los poderes del Estado y sus instituciones autónomas, que, junto con el lenguaje claro, coadyuven al encuentro comunicativo entre justicia y ciudadano.

The language of justice has been characterized by its impenetrability: its archaic expressions, Latinisms, technicisms, circumlocutions, complex words and sentences full of subordinates avoid understanding it and make the use of a “translator” mandatory. Here we propose the use of the plain language to ensure that the judge addresses the person involved in the process as the primary recipient of his message, a citizen who has the right to understand. His language should allow him to approach the citizen who will be affected by his sentence and not, on the contrary, emphasize the differences between them which would only distance them. In order to achieve this, we have identified violations of the plain language guidelines in actual rulings and we propose a simple and understandable new version. We have also consulted various professionals involved in the justice system —a judge, a judicial linguist, a former secretary of the JNJ, the Open Government coordinator of the PCM, and the representative of the main proponent of the Red Peruana de Lenguaje Claro Oficial— to help us understand the status of plain language and justice in Perú today. We also propose a series of guidelines to the different branches of the government and autonomous institutions that will contribute to the communicative encounter between justice and citizens through clear language.
