Abstract
El derecho a una educación universitaria de calidad al igual que otros derechos
fundamentales, pueden ser impactado negativamente por decisiones erróneas
del Tribunal Constitucional. La educación como derecho fundamental intrínseco
constituye uno de los medios para lograr el desarrollo pleno de las personas y
con ello el de la sociedad, por lo que es necesario no solo su protección
constitucional sino también una atención prioritaria del Estado en la
implementación de políticas públicas adecuadas, de mecanismos eficientes de
control y seguimiento en la gestión. Sin embargo, esta estructura está sujeta a
los vaivenes coyunturales en los que muchas veces los grupos de poder a
través de los legisladores consiguen no solo la emisión de normas legales que
privilegian el interés particular sobre el colectivo, sino que también utilizan las
instituciones para validar las normas valiéndose de artificios procesales y
jueces condescendientes. En el presente informe se cuestiona el
pronunciamiento del Tribunal Constitucional bajo una perspectiva sistemática
con enfoque en Derechos Humanos, utilizando como parámetros de control, a
la Constitución peruana, a los Acuerdos Internacionales vinculantes y la propia
jurisprudencia constitucional. Producto del análisis metodológico se determina
que el Tribunal Constitucional ha optado por un ejercicio laxo tanto en la parte
procesal como en el análisis relativos a la vulneración de derechos
fundamentales. Finalmente, se concluye que la sentencia que convalida la Ley
31520 atenta contra el derecho fundamental a la educación universitaria de
calidad.
The right to a quality university education, like other fundamental rights, may be negatively affected by erroneous decisions of the Constitutional Court. Education as an intrinsic fundamental right is one of the means to achieve the full development of people and with it that of society, so it is necessary not only its constitutional protection but also a priority attention of the State in the implementation of suitable public policies, efficient mechanisms of control and monitoring in management. However, this structure is subject to the ups and downs in which power groups through legislators often achieve not only the issuance of legal norms that privilege the particular interest over the collective, but also use institutions to validate the norms by means of procedural artifices and condescending judges. This report questions the pronouncement of the Constitutional Court from a systematic perspective with a focus on human rights, using as control parameters, the Peruvian Constitution, binding international agreements and constitutional jurisprudence itself. As a result of the methodological analysis, it is determined that the Constitutional Court has opted for a lax exercise both in the procedural part and in the analysis related to the violation of fundamental rights. Finally, it is concluded that the sentence validating Law 31520 violates the fundamental right to a quality university education
