Abstract
La colusión es un delito de infracción de deber tipificado en el artículo 384° del Código
Penal peruano que ha sido interpretado de diversas maneras por los operadores de justicia,
así como por la doctrina. Sin embargo, pese a su estudio constante no se ha logrado
uniformizar la interpretación sobre sus alcances. Tal es el caso de la Casación N° 542-2017
Lambayeque, en la cual los magistrados no llegaron a un consenso sobre la delimitación e
interpretación del tipo penal, por ello la aplicación a los hechos resulta discutible, ya que con
diversas posturas se puede llegar a soluciones disímiles.
Por lo tanto, dado el análisis respectivo se llega a la conclusión de que el bien jurídico
aplicable al delito de colusión es la imparcialidad en la actividad contractual del Estado.
Asimismo, los supuestos del artículo 384° de la citada norma constituyen dos modalidades,
una colusión simple y otra agravada. De lo cual, para configurar la primera se requiere de
una concertación donde existe un peligro potencial al patrimonio del Estado, mientras que,
para la colusión agravada, se requiere de un resultado que implica el perjuicio patrimonial
efectivo y cuantificable. Así, en el caso debió probarse la sobrevaloración económica o
perjuicio patrimonial para imputar a los procesados el delito de colusión agravada.
Collusion is a crime of infringement of duty typified in Article 384 of the Peruvian Penal Code, which has been interpreted in various ways by justice operators, as well as by doctrine. However, despite its constant study, it has not been possible to standardize the interpretation of its scope. Such is the case of Cassation No. 542-2017 Lambayeque, in which the magistrates didn’t reach a consensus on the delimitation and interpretation of the criminal type, therefore the application to the facts is debatable, since with different positions it is possible come up with dissimilar solutions. Therefore, given the respective analysis, it has concluded that the legal good applicable to the crime of collusion is impartiality in the contractual activity of the State. Likewise, the cases of article 384 of the aforementioned rule constitute two modalities, a simple collusion and an aggravated one. From which, to configure the first, a concertation is required where there is a potential danger to the State's assets, while, for aggravated collusion, a result that implies effective and quantifiable patrimonial damage is required. Thus, in the case, the economic overvaluation or patrimonial damage had to be proven to charge the defendants with the crime of aggravated collusion.
