Abstract
El presente informe examina la presunta infracción a la Ley de Represión de la
Competencia Desleal (LRCD) atribuida a Frigoinca S.A.C., una empresa dedicada a la
producción y comercialización de alimentos. El análisis aborda las declaraciones
vinculadas a la composición de sus productos, el cumplimiento de los estándares
técnicos requeridos por el Programa Nacional de Alimentación Escolar Qali Warma, y
la posible omisión de información, como la incorporación de aditivos fosfatos.
El estudio se enfoca en dilucidar si las prácticas adoptadas por Frigoinca
transgredieron los principios de veracidad y sustanciación previa contemplados en la
LRCD, en atención a la insuficiencia y falta de idoneidad de las pruebas presentadas
para sustentar sus afirmaciones. Asimismo, se analiza el impacto potencial de dichas
conductas en el mercado, particularmente en el marco de los procesos de contratación
pública, y las implicancias derivadas de la carencia de mecanismos técnicos
adecuados para la verificación de la información presentada en estas relaciones
comerciales.
Finalmente, se subraya la importancia de fortalecer el control estatal a través de
laboratorios acreditados por el Instituto Nacional de Calidad (Inacal). Este enfoque
permite identificar los desafíos en la supervisión y sanción en el mercado, destacando
la necesidad de garantizar relaciones comerciales transparentes y condiciones de
competencia equitativas.
The present report examines the alleged violation of the Law for the Repression of Unfair Competition (LRCD) attributed to Frigoinca S.A.C., a company engaged in the production and marketing of food products. The analysis addresses statements related to the composition of its products, compliance with the technical standards required by the Qali Warma National School Feeding Program, and the possible omission of information, such as the inclusion of phosphate additives. The study focuses on determining whether the practices adopted by Frigoinca violated the principles of truthfulness and prior substantiation contemplated in the LRCD, considering the insufficiency and inadequacy of the evidence presented to support its claims. Additionally, it examines the potential impact of these practices on the market, particularly within the context of public procurement processes, and the implications arising from the lack of appropriate technical mechanisms for verifying the information submitted in such commercial relations. Finally, the report emphasizes the need for clear, consistent, and predictable criteria in the grading of sanctions imposed by the National Institute for the Defense of Competition and Protection (Indecopi), as well as the importance of strengthening state oversight through laboratories accredited by the National Institute of Quality (Inacal). This approach helps identify challenges in market supervision and sanctioning, highlighting the necessity of ensuring transparent commercial relationships and equitable competition conditions.
