Abstract
El presente informe discute, a partir del Exp. Nº 02010-2020-PHC/TC (Hábeas
Corpus de Alberto Fujimori), si la decisión del Tribunal Constitucional de
desacatar lo ordenado por la Corte Interamericana de Derechos Humanos en
sus distintas resoluciones con respecto a los casos de las masacres de La
Cantuta y Barrios Altos, a través de la emisión de un Auto del propio Tribunal
que restablece los efectos del indulto otorgado al expresidente, vulnera el
principio de corrección del Buen Gobierno. Asimismo, también se cuestiona si el
cumplimiento de las obligaciones internacionales en DD.HH. del Estado peruano
es concordante con los principios y valores constitucionales a los que está sujeto
el principio de corrección.
Los instrumentos normativos que se emplean son las Resoluciones de la Corte
IDH, la Convención Americana sobre Derechos Humanos, las Resoluciones del
Tribunal Constitucional y cierta jurisprudencia que versa sobre el buen gobierno
y el cumplimiento de obligaciones internacionales por parte del Estado. Después
de hacer una revisión de todos estos elementos, este informe termina
concluyendo que la decisión que adoptó el Tribunal Constitucional de restablecer
los efectos del indulto al expresidente Fujimori afecta a la persecución del Estado
Constitucional de Derecho como un objetivo a lograr y mantener. Por
consiguiente, esto también afecta al buen gobierno como valor fundamental de
este Estado de Derecho, entendiendo que el cumplimiento de las obligaciones
en DD.HH. del Estado también forma parte de la conformación de un buen
gobierno, el cual garantiza el acceso a la justicia para todos sus ciudadanos.
This legal report questions, on the basis of Exp. Nº 02010-2020-PHC/TC (Alberto Fujimori's habeas corpus), whether the Constitutional Court's decision to disregard the orders of the Inter-American Court of Human Rights in its various resolutions regarding the cases of the Barrios Altos and La Cantuta massacres, by issuing a Court Order that reestablishes the effects of the pardon granted to the former president, violates the principle of correctness of Good Government. Likewise, it is also questioned whether the Peruvian state's compliance with its international human rights obligations is consistent with the constitutional principles and values to which the principle of correction is subject. The normative instruments used are the Resolutions of the Inter-American Court of Human Rights, the American Convention on Human Rights, the Resolutions of the Constitutional Court and certain jurisprudence that deals with good governance and the state's compliance with its international obligations. After reviewing all these elements, this report concludes that the Constitutional Court's decision to reinstate the effects of the pardon of former President Fujimori affects the pursuit of the constitutional rule of law as an objective to be achieved and maintained. Consequently, this also affects good governance as a fundamental value of the rule of law, with the understanding that the fulfilment of the State's human rights obligations is also part of good governance, which guarantees access to justice for all its citizens.
