Informe jurídico sobre la Resolución Nº0194-2015/SPC-INDECOPI

Abstract

El presente trabajo aborda las vulneraciones al deber de idoneidad cometidas por la Cooperativa de Ahorro y Crédito de Ilo Ltda. N.º 50 y el Banco de Crédito del Perú S.A., en el contexto de un procedimiento administrativo seguido ante el INDECOPI. En cuanto a la mencionada Cooperativa, se pone en manifiesto la modificación unilateral de la tasa de interés en los contratos de crédito sin una debida información clara y transparente sobre los cambios, vulnerando el artículo 19° del Código del Protección y Defensa del Consumidor. En cuanto al Banco, se evalúa si la retención de los fondos de Compensación por Tiempo de Servicios (CTS) realizada respecto a uno de los consumidores se efectuó sin haber proporcionado previamente información adecuada sobre el procedimiento ni sobre las consecuencias legales que ello implicaba, contraviniendo así la obligación del proveedor al disponer de los fondos de un usuario financiero. En adición, se hace una revisión del método de cobranza empleado por la Cooperativa al emplear una comunicación en donde alude a una actuación judicial sin tener una orden o base firme, pudiendo inducir a error o confusión al consumidor e infringiendo los artículos 61° y 62° del Código del Protección y Defensa del Consumidor, las cuales prohíben los métodos de cobranza intimidatorios.

This paper addresses violations of the duty of suitability committed by Cooperativa de Ahorro y Crédito de Ilo Ltda. No. 50 and Banco de Crédito del Perú S.A., in the context of administrative proceedings before INDECOPI. With regard to the aforementioned Cooperative, it highlights the unilateral modification of the interest rate in credit agreements without providing clear and transparent information about the changes, in violation of Article 19 of the Consumer Protection and Defense Code. With regard to the Bank, it is being assessed whether the withholding of Severance Pay (CTS) funds from one of the consumers was carried out without first providing adequate information about the procedure or the legal consequences involved, thus contravening the provider's obligation when disposing of a financial user's funds. In addition, a review is being conducted of the collection method used by the Cooperative, which employed a communication alluding to legal action without having a firm order or basis, which could mislead or confuse the consumer and violates Articles 61 and 62 of the Consumer Protection and Defense Code, which prohibit intimidating collection methods.
