Resumen
En el presente Informe Jurídico se pretende analizar la Sentencia de Apelación
N° 2-2020/ La Libertad, emitida por la Sala Penal Permanente de la Corte
Suprema de Justicia. El contexto en el que se desarrolla esta sentencia tiene
lugar en el Juzgado Mixto de La Libertad, espacio en el que, el entonces
magistrado, José Helí Gálvez Chávez solicitó favores sexuales por más de 3
ocasiones a la justiciable Edith Edelmira Vásquez Miranda a fin de beneficiarla
en el proceso seguido por ella en calidad de demandante, aprovechándose que
el juez a cargo era el mismo Sr. Gálvez Chávez. Al judicializarse el caso, se
admiten audios no homologados como prueba, junto a otros elementos
probatorios, a fin de atribuirle al magistrado el delito de cohecho pasivo
específico en calidad de autor. Ante ello, la defensa del imputado apela la
sentencia condenatoria valiéndose de una deficiente valoración probatoria,
especialmente con los audios no periciados, así como de los testimonios y
pruebas empleadas para acreditar la solicitud de un favor sexual. Es por esta
razón que se analizará el fallo de segunda instancia sirviéndose de conceptos
relacionados al delito específico, a la valoración probatoria, regulada en los
artículos 158° y 393° del Código Procesal Penal y, sobre todo, empleando el
enfoque de género bajo la premisa de una relación estructural detectada entre el
juez y la usuaria, cuestión que no fue considerada en ninguna de las instancias.
Demostrando cuan sustancial puede la aplicación de este enfoque cuando
confluyen género y corrupción.
In this Legal Report we intend to analyze the Appeal Judgment N° 2-2020/ La Libertad, issued by the Permanent Criminal Chamber of the Supreme Court of Justice. The context in which this sentence takes place is at the Tribunal de la Libertad, where the then magistrate, José Helí Gálvez Chávez requested sexual favors for more than 3 times to the justiciable Edith Edelmira Vásquez Miranda in order to benefit her in the process followed by her as a plaintiff, taking advantage of the fact that the judge in charge was the same Mr. Gálvez Chávez. When the case is adjudicated, unapproved audios are admitted as evidence, together with other evidentiary elements, in order to attribute to the magistrate the offence of specific passive bribery as author. The defence of the accused appeals against the conviction on the basis of inadequate evidentiary assessment, especially with regard to uncertified audio recordings, as well as the testimonies and evidence used to establish the request for a sexual favor. It is for this reason that the second instance judgment will be analyzed using concepts related to the specific crime, to the evidentiary assessment, regulated in articles 158° and 393° of the Code of Criminal Procedure and, above all, using the gender approach under the premise of a structural relationship detected between the judge and the user, a question that was not considered in any of the instances. Demonstrating how substantial the application of this approach can be when gender and corruption meet.
