Abstract
El presente informe analiza los principales fundamentos de la Resolución N° 1122-2007/TDCINDECOPI,
emitida por el Tribunal de Defensa de la Competencia y Propiedad Intelectual del Indecopi,
mediante la cual declara responsable a la empresa Ferrocarril Trasandino S.A.C (en adelante, Fetrans)
y le impone como medida correctiva el cese del abuso de la posición de dominio, así como una multa
ascendente a 165,9 UIT. Ello a propósito del procedimiento administrativo sancionador iniciado de
oficio y como consecuencia de la denuncia interpuesta por la empresa Ferrocarril Santuario Inca
Machupicchu S.A.C. La sanción impuesta corresponde a la infracción a los artículos 3° y 5° del Decreto
Legislativo N° 701 cometida por la empresa Fetrans, al haberse demostrado la negativa injustificada
de alquilar el material tractivo y rodante otorgado en concesión por el Estado peruano.
El análisis de los problemas jurídicos identificados nos permite afirmar la insuficiencia de la medida
correctiva ordenada por el Tribunal, siendo que, con dicho pronunciamiento, se dejó abierta la
posibilidad de que se continúe en un mercado con condiciones anticompetitivas, aún cumpliendo con
el mandato; por lo que, la reformulación de la misma o la consideración del servicio de alquiler de
material de locomotoras y vagones con capacidad de operar en el tramo Sur Oriente peruano (en
adelante, el material) por parte del Ositran , resultan alternativas menos gravosas que pudieron haber
sido consideradas por la autoridad administrativa o que podrían serlo en posteriores pronunciamientos.
En el mismo sentido, el análisis de los requisitos de validez de la resolución previa que habilita el
pronunciamiento del Tribunal nos permite afirmar la validez del acto administrativo en esta última
instancia.
This report analyzes the main foundations of Resolution No. 1122-2007/TDC-INDECOPI, issued by the Court for the Defense of Competition and Intellectual Property of Indecopi, by which it declares the company Ferrocarril Trasandino S.A.C (hereinafter, Fetrans) and imposes as a corrective measure the cessation of the dominant position, as well as a fine amounting to 165.9 UIT, this in connection with the disciplinary administrative procedure initiated ex officio and as a consequence of the complaint filed by the company Ferrocarril Santuario Inca Machupicchu S.A.C. The sanction imposed corresponds to the violation of articles 3 and 5 of Legislative Decree No. 701 committed by the Fetrans company, having demonstrated the unjustified refusal to rent the tractive and rolling stock granted in concession by the Peruvian State. The analysis of the legal problems identified allows us to affirm the insufficiency of the corrective measure ordered by the Court, being that, with said pronouncement, the possibility of continuing in a market scenario with anti-competitive conditions was left open, even in compliance with the mandate; Therefore, its reformulation or the consideration of the material rental service for locomotives and wagons with the capacity to operate in the Peruvian South East section (hereinafter, the material) by Ositran, are less burdensome alternatives that could have been considered by the authority or could be considered in subsequent pronouncements. In the same sense, the analysis of the validity requirements of the resolution that enables the Court's pronouncement allows us to affirm the validity of the administrative act in this last instance.
