Informe sobre la Resolución N° 0148-2024/SDC-INDECOPI : Risk Consulting S.A.C. y Risk Consulting Colombia S.A.S. contra Worldsys Perú S.A.C. y Carlos Alberto Wiesse Asenjo

Resumen
El presente informe jurídico analiza el pronunciamiento emitido por la Sala Especializada en Defensa de la Competencia del INDECOPI en la Resolución 0148-2024/SDC-INDECOPI, perteneciente al Expediente 0011-2023/CCD, el cual versa sobre la denuncia de Risk Consulting S.A.C. y Risk Consulting Colombia S.A.S. contra Worldsys Perú S.A.C. y Carlos Alberto Wiesse Asenjo por presuntas infracciones al Decreto Legislativo 1044 – Ley de Represión de la Competencia Desleal. Al respecto, se formularon cuatro imputaciones: (i) empleo indebido del sistema marcario, (ii) abuso de procesos legales, ambos bajo la cláusula general; (iii) denigración; y (iv) violación de secretos empresariales. A través del examen de los actuados, la doctrina y la jurisprudencia relevante se determinará si, en el caso concreto, concurren los elementos típicos de cada infracción y si la decisión administrativa resuelve correctamente los problemas jurídicos identificados. Sin perjuicio de ello, el eje central del presente informe es evaluar si la litigación predatoria, pese a que puede ser encausada competencia, debería naturaleza y efectos tanto en sede de competencia desleal como en libre ser conocida únicamente por esta última, dada la estructurales de esta conducta en el mercado. La relevancia de este trabajo radica en examinar a fondo -entre otras infracciones- uno de los casos más recientes sobre abuso de procesos legales y proponer criterios razonables para justificar una postura minoritaria en la doctrina pero que, desde nuestro punto de vista, mejora aún más la regulación de
competencia vigente.
This legal report analyzes the decision rendered by the Specialized Chamber for the Defense of Competition of INDECOPI through Resolution 0148-2024/SDC-INDECOPI, issued in the framework of Case File 0011-2023/CCD. The case concerns the complaint filed by Risk Consulting S.A.C. and Risk Consulting Colombia S.A.S. against Worldsys Perú S.A.C. and Carlos Alberto Wiesse Asenjo for alleged violations of Legislative Decree 1044 – Unfair Competition Repression Act. Four accusations were brought: (i) improper use of the trademark system and (ii) abuse of legal proceedings, both under the general clause; (iii) disparagement; and (iv) misappropriation of trade secrets. By examining the procedural record, doctrinal writings, and relevant case law, this study assesses whether the constituent elements of each infringement are met and whether the administrative decision adequately addresses the identified legal issues. The core focus, however, is to determine whether predatory litigation—although actionable under both unfair competition and antitrust regimes—should be adjudicated exclusively by the latter, given the conduct’s structural market effects. The significance of this work lies in providing an in-depth evaluation of one of the most recent cases on abuse of legal proceedings and in proposing sound criteria to support a minority doctrinal position that, in our view, would further enhance current competition regulation.
