Informe jurídico sobre la Resolución N° 1533- 2010/SC1-INDECOPI: competencia municipal y razonabilidad de las restricciones horarias

Abstract

El presente informe analiza la Resolución N° 1533-2010/SC1-INDECOPI, mediante la cual la Sala de Defensa de la Competencia N° 1 del Tribunal de la Competencia y Propiedad intelectual del INDECOPI declaró que la restricción general al horario de funcionamiento de los establecimientos comerciales, impuesta por la Municipalidad de Miraflores mediante la Ordenanza N° 263-MM, constituye una barrera burocrática carente de razonabilidad. El problema principal del caso radica en determinar si dicha medida vulnera los requisitos de legalidad y razonabilidad exigidos por el marco normativo. Asimismo, se analizarán los efectos jurídicos derivados de la declaratoria de la medida como barrera burocrática carente de razonabilidad. Para ello, se analizaron los criterios establecidos en el Decreto Ley N° 25868 (vigente al momento de los hechos), así como la normativa vigente del Decreto Legislativo N° 1256. La presente investigación concluye que, si bien la municipalidad cumplió con los requisitos de legalidad para emitir la restricción, esta no superó el análisis de razonabilidad. Asimismo, se abordan los distintos resultados que habría tenido el fallo de acuerdo con el marco normativo que se hubiese tomado en consideración para su resolución. Con ello, se analiza el desarrollo del marco normativo de las barreras burocráticas en el Perú y su repercusión en la resolución de casos de esta naturaleza.

This report analyzes Resolution No. 1533-2010/SC1-INDECOPI, issued by Chamber No. 1 for Competition Defense of the Tribunal for Competition and Intellectual Property of INDECOPI, whereby it was determined that the general restriction on the operating hours of commercial establishments—imposed by the Municipality of Miraflores through Ordinance No. 263-MM—constitutes an unreasonable bureaucratic barrier. The central issue of the case lies in determining whether the aforementioned measure violates the requirements of legality and proportionality established by the applicable legal framework. Additionally, the report examines the legal effects arising from the declaration of the measure as an unreasonable bureaucratic barrier. To this end, the analysis considers the criteria set forth in Legislative Decree No. 25868 (in force at the time of the events), as well as the current legal framework under Legislative Decree No. 1256. This study concludes that, although the municipality complied with the formal requirements of legality when enacting the restriction, the measure failed to meet the standards of proportionality. Furthermore, the report discusses the potential variations in the outcome depending on the legal framework applied at the time of resolution. In doing so, it assesses the evolution of the legal regime on bureaucratic barriers in Peru and its impact on the resolution of cases of this nature.
