Abstract
En el presente informe se analizan los principales problemas jurídicos que
surgen en el marco de un procedimiento de barreras burocráticas iniciado por la
empresa Wi-net Telecom S.A.C contra la Municipalidad de Miraflores, recaído en
el Expediente N° 000134-2022/CEB donde se discute la legalidad y
razonabilidad de la exigencia de presentar una autorización de uso de
infraestructura de terceros para la instalación de infraestructura de
telecomunicaciones.
El punto de partida es el análisis de cada uno de los cuatro (4) medios de
materialización alegados por Wi-net Telecom S.A.C en la interposición de su
denuncia para determinar si la Comisión es competente para pronunciarse sobre
ellos y, en consecuencia, si son susceptibles de ser analizados en un
procedimiento de barreras burocráticas.
Sin perjuicio de ello, es menester de este informe determinar la legalidad de la
barrera burocrática objeto de cuestionamiento. Para ello se utilizará el análisis
de legalidad empleado por el Indecopi que se divide en 3 aspectos; legalidad de
fondo-competencias, legalidad de forma y legalidad de fondo- compatibilidad con
otras normas.
Finalmente, de manera complementaria se abordarán otros temas tales como la
presunta vulneración del principio de continuidad de infracciones por las multas
consecutivas impuestas por la Municipalidad, entre otros.
This report analyzes the main legal issues arising in the context of a bureaucratic barrier procedure initiated by the company Wi-net Telecom S.A.C against the Municipality of Miraflores in Case No. 000134-2022/CEB, where the legality and reasonableness of the requirement to submit an authorization for the use of third parties infrastructure for the installation of telecommunications infrastructure is discussed. The starting point is the analysis of each of the four (4) means of materialization alleged by Wi-net Telecom S.A.C. in the filing of its complaint in order to determine whether the Commission is competent to rule on them and, consequently, whether they are susceptible to be analyzed in a bureaucratic barrier procedure. Notwithstanding the foregoing, it is the duty of this report to determine the legality of the bureaucratic barrier matter of this discussion. For this purpose, we are going to apply the legality analysis used by Indecopi, which is divided into three aspects: substantive legality-competences, formal legality and substantive legality-compatibility with other regulations. Finally, in a complementary manner, other issues such as the alleged violation of the principle of continuity of infractions by the consecutive fines imposed by the Municipality, among others, will be addressed.
