Informe jurídico de la Sentencia de la Corte Interamericana de Derechos Humanos en el Caso López Soto y Otros vs. Venezuela

Abstract

Este informe analiza la responsabilidad internacional del Estado venezolano en la violación de los derechos a la libertad personal e integridad de Linda López Soto, a partir de la sentencia de la Corte Interamericana de Derechos Humanos (Corte IDH). El caso establece que el Estado conocía el riesgo real que enfrentaba Linda y no actuó con la debida diligencia para protegerla, incumpliendo tanto su obligación de respeto como de garantía frente a hechos cometidos por un particular. En cuanto al derecho a la libertad personal, se estudia cómo la omisión estatal permitió la privación ilegítima de libertad y la esclavitud sexual de Linda. Aunque la Corte introduce un test específico para identificar la esclavitud sexual, el informe señala que no desarrolló de manera suficiente el análisis sobre el “estado o condición” de esclavitud, limitando así la profundidad jurídica del fallo. También se evidencian fallas institucionales, sustentadas en estereotipos de género, que impidieron una respuesta efectiva ante la desaparición y el riesgo de la víctima. Respecto al derecho a la integridad personal, se analiza la calificación de los hechos como tortura sexual y la falta de actuación estatal para prevenir, investigar y sancionar. Se cuestiona la superficialidad del análisis sobre la finalidad específica del acto de tortura y la ausencia de una perspectiva de género e interseccionalidad. En conclusión, aunque el fallo representa avances relevantes, la evaluación de la Corte resulta parcial y superficial en aspectos clave, debilitando el impacto transformador de su jurisprudencia sobre violencia sexual y de género.

This report analyzes the international responsibility of the Venezuelan State in the violation of Linda López Soto’s rights to personal liberty and integrity, based on the judgment of the Inter-American Court of Human Rights (IACtHR). The case establishes that the State was aware of the real and imminent risk Linda faced and failed to act with due diligence to protect her, thus breaching both its obligation to respect and to guarantee rights in the face of acts committed by a private individual. Regarding the right to personal liberty, the report examines how state omission enabled Linda’s unlawful deprivation of liberty and sexual slavery. Although the Court introduced a specific test to identify sexual slavery, the report highlights that it did not sufficiently develop the analysis of the “status or condition” of slavery, thereby limiting the legal depth of the ruling. Institutional failures, driven by gender stereotypes, are also evidenced, which hindered an effective response to the victim’s disappearance and risk. Concerning the right to personal integrity, the report analyzes the classification of the acts as sexual torture and the State’s failure to prevent, investigate, and punish them. The superficiality of the Court’s analysis regarding the specific purpose of the torture is questioned, as well as the lack of a gender and intersectional perspective. In conclusion, although the ruling represents important progress, the Court’s evaluation is partial and superficial in key areas, weakening the transformative impact of its jurisprudence on sexual and gender-based violence.
