Abstract
El objetivo de este trabajo es estudiar la posibilidad de modificar la demanda laboral una vez
notificada a la parte demandada, cuestionando los argumentos y la fuerza vinculante de los
plenos jurisdiccionales que avalan esta práctica. A través de un enfoque analítico, se
examinan los principios generales del derecho aplicables y se evalúan críticamente los plenos
jurisdiccionales de 2013 y 2017. La investigación concluye que existen principios y
situaciones excepcionales que permitirían la modificación de la demanda en escenarios
específicos, pero el principio de oralidad no desempeña un rol importante en esta discusión.
Se enfatiza la importancia de que jueces, abogados y legisladores adopten una visión
equilibrada que conjugue el acceso a la justicia con la seguridad jurídica procesal.
The main objective in this thesis is to discuss whether the reasons offered by the plenums for permitting the modification of the claim are correct and whether these plenums are binding. Through an analytical approach, the general principles of law are examined, and the 2013 and 2017 judicial plenums are critically evaluated. The research concludes that there are principles and exceptional situations that would allow the modification of the claim in specific scenarios, but the principle of orality does not play a significant role in this discussion. It emphasizes the importance for judges, lawyers, and legislators to adopt a balanced view that combines access to justice with legal certainty.
