Abstract
El caso de la niña A.S.C.V., cuyo progreso académico se desarrolló en
circunstancias excepcionales debido a la aplicación inflexible de las Directivas
del Ministerio de Educación. Dichas Directivas establecen un criterio estricto
basado en la edad cronológica para la matrícula en los niveles educativos, lo que
inicialmente impidió el acceso formal de la niña al sistema educativo. Esta
situación provocó una afectación de sus derechos fundamentales a la educación
y al libre desarrollo de la personalidad, protegidos tanto por la Constitución
Política del Perú como por la Convención sobre los Derechos del Niño.
Esta medida es crucial para mantener la coherencia y efectividad del sistema
educativo, ofreciendo igualdad de oportunidades de aprendizaje para todos los
niños. Las Directivas reflejan una política educativa coherente bajo estándares
normativos, evitando la informalidad y asegurando la permanencia de los
estudiantes en el sistema formal.
El Tribunal Constitucional priorizó el interés superior del niño al resolver el caso,
fundamentándose en principios como la proporcionalidad y la precaución. La
decisión de inaplicar las Directivas para reconocer el progreso educativo de
A.S.C.V. resalta la importancia de equilibrar las normas administrativas con los
derechos fundamentales, asegurando la continuidad educativa de la niña sin
afectar su bienestar emocional ni su desarrollo integral.
The case of the child A.S.C.V., whose academic progress was developed in exceptional circumstances due to the inflexible application of the Directives of the Ministry of Education. Said directives establish a strict criterion based on chronological age for enrollment in educational levels, which initially prevented the child's formal access to the educational system. This situation affected her fundamental rights to education and to the free development of her personality, protected by both the Political Constitution of Peru and the Convention on the Rights of the Child. This measure is crucial to maintain the coherence and effectiveness of the educational system, offering equal learning opportunities for all children. The Directives reflect a coherent educational policy under normative standards, avoiding informality and ensuring the permanence of students in the formal system. The Constitutional Court prioritized the best interests of the child in deciding the case, based on principles such as proportionality and precaution. The decision to inapply the directives to recognize the educational progress of A.S.C.V. highlights the importance of balancing administrative rules with fundamental rights, ensuring the child's educational continuity without affecting her emotional wellbeing or her integral development.
