Informe jurídico sobre la Sentencia del Tribunal Constitucional Exp. Nº00238-2021-PA/TC

Abstract

En el año 2023, se emitió la sentencia del Tribunal Constitucional, recaída en el expediente N°00238-2021-PA/TC, donde se declaró fundada la demanda de amparo interpuesta por Violeta Gómez Hinostroza, y ordenó al MINSA que informe y distribuya gratuitamente el Anticonceptivo Oral de Emergencia (AOE) en todos los centros de salud estatales. A partir de dicha decisión, el presente informe jurídico se desarrolló con la finalidad de determinar si es que la restricción previa sobre el AOE, respecto a su distribución y difusión de información, implicaba o no una vulneración de los derechos sexuales y reproductivos, así como una afectación al principio de igualdad y no discriminación de las personas con capacidad de gestar. Para ello, se recurrió al análisis del estándar internacional y nacional de los DSR y el principio citado, acudiendo a tratados internacionales como el PIDESC, la CEDAW y el CIDI. Asimismo, en relación a la jurisprudencia, se tomaron en cuenta las sentencias de la Corte IDH respecto a los casos Britez Arce vs .Argentina, Manuela y otros vs. El Salvador y el caso I.V. vs. Bolivia. De lo investigado se concluyó que la medida adoptada por el MINSA sí vulnera los DSR de las personas con capacidad de gestar, en particular su derecho a la autonomía reproductiva, al afectar las dimensiones de accesibilidad y aceptabilidad del derecho a la salud. Asimismo, la medida se configura como discriminatoria, del tipo indirecta e interseccional, al afectar a las personas del colectivo señalado en condiciones económicas vulnerables.

In 2023, the Constitutional Court issued a judgment in case No. 00238-2021-PA/TC, in which it upheld the amparo action filed by Violeta Gómez Hinostroza and ordered the Ministry of Health (MINSA) to provide information on and distribute the Emergency Contraceptive Pill (ECP) free of charge in all public health centers. Based on this decision, the present legal report was developed with the aim of determining whether the previous restriction on the ECP—both in terms of its distribution and the dissemination of related information—constituted a violation of sexual and reproductive rights (SRRs), as well as an infringement of the principle of equality and non- discrimination of individuals with the capacity to gestate. To that end, the analysis drew on both international and national standards concerning SRRs and the aforementioned principle, referring to international treaties such as the ICESCR, CEDAW, and the Inter-American Convention on the Prevention, Punishment, and Eradication of Violence against Women (Belém do Pará Convention). In terms of jurisprudence, the analysis considered key rulings of the Inter-American Court of Human Rights, specifically the cases of Britez Arce v. Argentina, Manuela et al. v. El Salvador, and I.V. v. Bolivia. Based on the research conducted, it was concluded that the measure adopted by MINSA indeed violated the SRRs of individuals with the capacity to gestate, particularly their right to reproductive autonomy, by undermining the accessibility and acceptability dimensions of the right to health. Furthermore, the measure constituted a form of indirect and intersectional discrimination, disproportionately affecting members of this group who are in economically vulnerable situations.
