Abstract
El presente estudio se enfoca en la transgresión del derecho a la libertad de
tránsito en las playas del Sur de Lima causada por la ausencia de accesos que
garanticen a todos los ciudadanos el disfrute de estas áreas. Para ello, se
propone un análisis de la normativa y el régimen legal vigente, que será dividido
en tres partes. En primer lugar, se abordará el desarrollo urbanístico en los
balnearios de Lima, comenzando con el concepto del urbanismo, sus
implicaciones y objetivos. A continuación, se realizará un análisis general sobre
el desarrollo de la planificación urbana en el Perú, a través de diversos
instrumentos aplicados en la construcción de los balnearios. Asimismo, se
abordará de manera más detallada el Plan de Desarrollo Urbano de Lima
Balnearios del Sur (en adelante PDU-LBS) así como los lineamientos para la
habilitación urbana en las playas conforme al Reglamento Nacional de
Edificaciones (RNE) y la Ley de Playas. En segundo lugar, se analizará el
desarrollo vial y las rutas de acceso en las playas del Sur de acuerdo al
Reglamento Nacional de Gestión de Infraestructura Vial, el Reglamento de
Jerarquización Vial y la ley de playas, con el objetivo de determinar las rutas de
acceso que deben existir para las playas de Sur y se determinará a las entidades
competentes para asegurar el cumplimiento de la normativa. Finalmente, se
definirá el alcance del derecho a la libertad de tránsito y las razones de su
vulneración, que incluyen desde expresiones discriminatorias por parte de los
propietarios de los condominios del Sur, hasta la carencia de un diseño
urbanístico adecuado. Se abordará la norma infringida al obstaculizar el acceso
a la playa, así como las sanciones correspondientes.
The present research work deals with the violation of the right to freedom of movement on the southern beaches of Lima, caused by the lack of access points that guarantees all citizens the enjoyment of these areas. For this purpose, we will analyze the regulations and the current legal regime in three parts. First, we will address urban development in the beaches of Lima, starting with the concept of urbanism, its implications and objectives. Next, we will examine in general terms how urban planning is developed in Peru through the urban planning instruments applied in the construction of beach resorts. Then, we will detail the Urban Development Plan for Lima Beach Resorts in the South and the guidelines for urban development on the beaches in accordance with the National Building Regulations and the Beach Law. Secondly, we will analyze the road development and access routes on the beaches of the South in accordance with the National Regulations for Road Infrastructure Management, the Road Hierarchy Regulations and the beach law, with the aim of determining the roads and access routes that must exist for the beaches of the South, as well as the competent entities to ensure compliance with the regulations. Finally, we will define the scope of the right to freedom of movement and the reasons for its violation, which range from discriminatory expressions by the owners of the condominiums in the South to the lack of adequate urban planning. We will also mention the rules violated and the corresponding sanctions.
