Laudo arbitral del arbitraje ad hoc entre Consorcio Som Lima Norte y el Servicio de Parques de Lima – SERPAR Lima

Abstract
En el presente informe se analiza el laudo arbitral del arbitraje seguido entre el Consorcio
Som Lima Norte y el Servicio de Parques de Lima – SERPAR LIMA cuyas controversias
centrales son el incumplimiento de obligaciones contractuales, la intervención económica de
la obra, la resolución de parcial de contrato realizada por SERPAR y la posterior resolución
total del contrato realizada por el Consorcio. Así como el consentimiento de esta última al no
haberse sometido a controversia dentro del plazo de caducidad establecido en la normativa de
contrataciones.
Por un lado, SERPAR imputó al Consorcio Som Lima Norte la reducción de recursos de obra
y paralización progresiva de ejecución como incumplimiento de obligaciones contractuales.
Por ello, primero resuelve intervenir económicamente la obra y luego resolver de forma
parcial el contrato respecto al saldo de ejecución pendiente. Por otro lado, el Consorcio Som
Lima Norte imputó a SERPAR el incumplimiento de obligaciones de pago y la demora en
liberación de terrenos para la ejecución de obra, lo cual se materializó en la resolución total
del contrato por parte del contratista.
Así, en el presente informe se analiza si las partes cumplieron con los procedimientos y
requisitos establecidos en la Ley de Contrataciones del Estado y su reglamento y si el
razonamiento del Tribunal Arbitral para tomar la decisión plasmada en el laudo es conforme
a la normativa de contrataciones.
This report analyzes the arbitration award of the arbitration followed between Consorcio Som Lima Norte and the Servicio de Parques de Lima - SERPAR LIMA, whose central disputes are the breach of contractual obligations, the economic intervention of the work, the partial resolution of contract carried out by SERPAR and the subsequent total resolution of the contract carried out by the Consortium. As well as the consent of the latter for not having submitted to controversy within the expiration period established in the contracting regulations. On the one hand, SERPAR charged the Som Lima Norte Consortium with the reduction of work resources and the progressive stoppage of execution as non-compliance with contractual obligations. For this reason, it first resolves to financially intervene in the work and then partially resolve the contract with respect to the balance of pending execution. On the other hand, the Som Lima Norte Consortium charged SERPAR with non-compliance with payment obligations and the delay in releasing land for the execution of the work, which materialized in the total termination of the contract by the contractor. Thus, this report analyzes whether the parties complied with the procedures and requirements established in the State Procurement Law and its regulations and whether the reasoning of the Arbitral Tribunal for making the decision embodied in the award is in accordance with the procurement regulations.
