Resumen
El presente informe gira en torno a tres problemas encontrados en la Casación
N°753-2022/Callao: el uso del principio de confianza para eximir de
responsabilidad a los directores de CORPAC, conformado por Walter Hugo Tello
y Percy Velarde; la falta de aplicación de reparación civil al Directorio aludido y
la determinación de la pena sin haber realizado una verificación sobre qué
sistema genera mayor favorabilidad a los procesados, el cual incluye a los
directores mencionados anteriormente y al Gerente municipal de la
Municipalidad Provincial del Callao, Marco Antonio Palomino. Sobre ello, se lleva
a cabo un análisis a partir de la doctrina nacional y se concluye que los
magistrados no debieron emplear el principio de confianza, en tanto no
consideraron los deberes de verificación y control que poseían los directores de
CORPAC por tener bajo su cargo a la Gerencia general de CORPAC, asimismo,
también se dispone que el Directorio actuó con dolo al infringir con su deber
extrapenal, tomando como base la “teoría de la infracción del deber” de Claus
Roxin, por ende, corresponde la aplicación de la reparación civil; por último, se
determina que el sistema de tercios es el más favorable para los procesados del
caso correspondiente debido a que posee parámetros objetivos que regulan la
pena en base a las agravantes y atenuantes, en cambio el sistema originario se
basaba únicamente en la discrecionalidad del juez.
This essay revolves around three problems that I found in Cassation No. 753- 2022/Callao: the use of the principle of trust to exempt the directors of CORPAC from liability, which consist of Walter Hugo Tello and Percy Velarde; the lack of application of civil reparation to the Directory and the determination of the penalty without having carried out a verification on which system generates more benefit for the indicted, which includes the directors mentioned above and the municipal manager of the Provincial Municipality of Callao, Marco Palomino. Regarding this, the analysis of this essay is based on national doctrine and concludes that the magistrates should not have used the principle of trust since they did not consider the verification and control duties that directors of CORPAC had for having the General Management of CORPAC under their wings, likewise, it is also established that the board of directors acted with malice by violating its extracriminal duty, based on Claus Roxin's theory “violation of duty”, therefore, it correponds the application of civil reparation; Finally, it is determined that the system of thirds is the most favorable for the indicted because it has objective parameters that regulate the penalty based on aggravating and mitigating circumstances, whereas the original system was based solely on the discretion of the judge.
