Abstract
En la actualidad, contamos con una diversidad de regímenes laborales especiales,
dada la singular naturaleza de las relaciones laborales desde su nacimiento,
ejecución y extinción. Este amplio abanico de contratos especiales,
específicamente en el sector privado, en su gran mayoría, se justifican
principalmente en la actividad económica a desarrollar, como es el caso de la
pesca, agricultura o construcción y, en otros casos, en el fin promocional que
buscan lograr.
Desde nuestra perspectiva, resulta más relevante reflexionar previamente si
realmente nos encontramos frente a uno de ellos; es decir, si las particularidades
de la relación laboral que en concreto se analiza son lo suficientemente relevantes
o sustanciales para que la regla sea la aplicación de una norma laboral especial y,
de manera supletoria, acudamos a las normas laborales de carácter general.
En la presente investigación abordamos un pormenorizado estudio del régimen
laboral agrario, a fin de sustentar que, en estricto, este no supone uno de tipo
especial como tradicionalmente se le califica, sino más bien uno de carácter
general o común con particularidades, lo cual se evidencia a partir del proceso de
las relaciones laborales en el sector agrario.
Nowadays, given the unique nature of labour relations since their conception, execution and termination, we have an ample variety of special labour regimes. This wide range of special contracts, specifically in the private sector, in its vast majority, are justified mainly in the economic activity where they develop, such as fishing, agriculture or construction and, in other cases, in the promotional purpose that they seek to achieve. In our view, it is more relevant to analize if we really find ourselves facing one of them; which means, if the particularities of the employment relationship that is specifically analyzed are sufficiently relevant or substantial for the rule to be the application of an special labour regulation and, in a supplementary manner, we turn to the general labour regulations. In this research we address a detailed study of the agrarian labour regime, in order to sustain that, strictly speaking, this does not suppose a special regime as it is traditionally described, but rather a general or common one with particularities, which is evidence from the practical development of individual and collective labour relations in the agricultural sector.
