Abstract
El informe jurídico presentado, a través de este documento, expone los efectos de la
aplicación de la potestad sancionadora, que ostenta el Organismo Supervisor de la
Inversión en Infraestructura de Transporte de Uso Público (en adelante, el OSITRAN)
frente a sus administrados; como en este caso, lo es la empresa Concesionaria Vial
del Perú (en adelante, COVIPERÚ).
Al respecto, en el desarrollo de este informe jurídico se presentarán problemas
jurídicos que se encuentran relacionados al posible incumplimiento de ciertas
cláusulas del Contrato de Concesión firmado entre el Ministerio de Transportes y
Comunicaciones (en adelante, el MTC) y COVIPERÚ, la suspensión del
procedimiento administrativo sancionador (en adelante, PAS) iniciado por el
OSITRAN, así como la facultad otorgada a este organismo para sancionar a través
del PAS a sus administrados.
En ese sentido, los instrumentos normativos empleados para el análisis y desarrollo
del presente trabajo son la Constitución Política del Perú, La Ley N° 27444, Ley del
Procedimiento Administrativo General, el Texto Único Ordenado de la Ley N° 27444,
el Reglamento General del OSITRAN, el Reglamento de Sanciones e Infracciones del
OSITRAN, entre otros.
Finalmente, las principales conclusiones de este trabajo académico, después del
análisis realizado, se concluye que COVIPERÚ no incumplió ninguna cláusula del
Contrato de Concesión firmado con el MTC, el PAS sí debió ser suspendido a pesar
de que OSITRAN tenía facultades para iniciar este procedimiento.
The legal report presented, through this document, exposes the effects of the application of the sanctioning power that the Supervising Organism of the Investment in Transportation Infrastructure for Public Use (hereinafter, OSITRAN) has over its administrators; as in this case, the company Concesionaria Vial del Perú (hereinafter, COVIPERÚ). In this regard, this legal report will present legal problems related to the possible breach of certain clauses of the Concession Agreement signed between the Ministry of Transportation and Communications (hereinafter, the MTC) and COVIPERÚ, the suspension of the administrative sanctioning procedure (hereinafter, PAS) initiated by OSITRAN, as well as the power granted to this agency to sanction through the PAS to its administrators. In this sense, the normative instruments used for the analysis and development of this work are the Political Constitution of Peru, Law No. 27444, General Administrative Procedure Law, the Single Ordered Text of Law No. 27444, OSITRAN's General Regulations and OSITRAN's Sanctions and Infractions Regulations. Finally, the main conclusions of this academic work, after the analysis carried out, it is concluded that COVIPERÚ did not breach any clause of the Concession Contract signed with the MTC, the PAS should have been suspended even though OSITRAN was empowered to initiate this procedure.
