Resumen
Mediante el presente informe se realizó un análisis de la Casación No. 13969-
2019-LIMA SUR, mediante el cual el voto en mayoría de la Corte Suprema validó
el despido de Guillermo Joyo Galván. Según el criterio del colegiado superior
estaba acreditado que se encontró al extrabajador dormido dentro del camión
mixer asignado a él. En este informe se examinó si es que la sentencia es
compatible con los principios y fundamentos del Derecho del Trabajo.
Para el desarrollo del análisis se ha utilizado principalmente los siguientes
instrumentos normativos: la Constitución Política del Perú, el Texto Único
Ordenado del Decreto Legislativo No. 728, Ley de Productividad y
Competitividad Laboral, así como la Nueva Ley Procesal del Trabajo.
En la conclusión se sostiene que la decisión del voto en mayoría en la Casación
no es compatible con los principios y fundamentos del Derecho del Trabajo
porque no se comprobó el incumplimiento de obligaciones suficiente para
quebrantar la buena fe laboral. Además, pese a haber adoptado la posición de
la Empresa, la Corte Suprema no realizó un análisis de razonabilidad y
proporcionalidad en la sanción aplicada. Finalmente, tampoco se comprobó que
la empresa demandada hubiera acreditado la causa justa del despido.
This legal report presents an analysis of Supreme Court Cassation No. 13969- 2019-LIMA SUR, through which the majority opinion of the Supreme Court upheld the dismissal of Mr. Guillermo Joyo Galván. According to the reasoning of the higher court, it was deemed proven that the former employee had been found asleep inside the concrete mixer truck assigned to him. This report examines whether the ruling is consistent with the ruling is consistent with the principles and foundational doctrines of Labor Law. The analysis is based primarily on the following legal instruments: Political Constitution of Peru, Consolidated Text of Legislative Decree No. 728, Law on Productivity and Labor Competitiveness, and the New Laboral Procedural Law. This report concludes that the majority opinion in the Cassation decision is not compatible with the principles and foundations of Labor Law, as there was no sufficient proof of breach of obligations capable of undermining the duty of good faith in the employment relationship. Moreover, even after adopting the employer’s position, the Supreme Court failed to conduct an analysis of reasonableness and proportionality regarding the sanction imposed. Finally, it was not established that the employer had duly proven just cause for dismissal in accordance with the legal standards required.
