Abstract
resolución N° 1183 – 2018 – SUNARP- TR – L, en el cual se busca inscribir un inmueble
en el registro de predios, el cual es observado por el Registrador Público el cual alega que
por la situación de estar casada la solicitante al momento de la presentación del título, el
bien debe tener la condición de bien social, salvo que se pruebe mediante documento de
fecha cierta que el mismo ha sido adquirido antes de la vigencia del matrimonio. Se solicita
la apelación a la observación formulada por el Registrador Público señalando que existiría
un error por parte de la calificación del Registrador Público debido a que se habría
solicitado que se inscriba el bien como propio y este lo ha considerado como social.
En apelación el Tribunal Registral, quien es el encargado de resolver en segunda instancia,
confirma lo señalado por el Registrador Público, reiterando que es necesario que se
presente ante los Registros Públicos documentos fehacientes donde la solicitante
demuestre que ha adquirido con fecha anterior al matrimonio, y por lo tanto antes de que
nazca la sociedad conyugal, por lo que confirma la denegatoria de inscripción formulada.
This report deals with the legal situations and problems found in resolution No. 1183 - 2018 - SUNARP- TR - L, in which a property is sought to be registered in the property registry, which is observed by the Public Registrar which alleges that due to the fact that the applicant is married at the time of presentation of the title, the property must have the status of social property, unless it is proven by means of a document of a certain date that it was acquired before the validity of the marriage. An appeal is requested to the observation made by the Public Registrar indicating that there would be an error on the part of the Public Registrar's qualification because it would have requested that the property be registered as its own and this has considered it as social. On appeal, the Registry Court, who is in charge of resolving in the second instance, confirms what was stated by the Public Registrar, reiterating that it is necessary to present reliable documents to the Public Registries where the applicant demonstrates that she has acquired a date prior to the marriage, and therefore before the conjugal partnership is born, thus confirming the denial of registration formulated.
