Resumen
En los últimos años, hemos sido testigos de la entrada de nuevos competidores
al mercado de las telecomunicaciones, sobre todo en la oferta de internet fijo.
Sin embargo, dicho dinamismo también ha provocado que organismos como el
INDECOPI tengan la tarea cada vez más compleja de dilucidar controversias de
competencia desleal entre un número mayor de agentes económicos, con el
objetivo de que el proceso competitivo no se vea distorsionado con prácticas
contrarias a la Ley de Represión de la Competencia Desleal (Decreto Legislativo
N° 1044), más aún en la era en la que la publicidad es susceptible de generar
mayor difusión y alcance a través de las redes sociales y plataformas web.
Precisamente, este trabajo aborda la Resolución N° 0068-2023/SDC-INDECOPI,
uno de los casos más recientes dilucidados por la Sala Especializada en Defensa
de la Competencia en el sector de telecomunicaciones, en el cual una empresa
prestadora del servicio de internet denuncia a una de sus competidoras por actos
contrarios a la buena y leal competencia que habría realizado a través de su
campaña publicitaria. A partir de ello, se procederá a realizar un análisis jurídico
de las presuntas infracciones relacionadas a actos de engaño, actos de
denigración y vulneración al principio de legalidad que se denuncian
principalmente en el caso para finalmente determinar si la Sala debió resolver
fundado o no los extremos denunciados.
In recent years, we have witnessed the entry of new competitors into the telecommunications industry, especially in the fixed Internet offer. However, such dynamism has also caused agencies such as INDECOPI to have the increasingly complex task of resolving disputes of unfair competition between a greater number of economic agents, with the aim of ensuring that the competitive process is not distorted with practices contrary to the Law for the Repression of Unfair Competition (Legislative Decree No. 1044), even more so in the era in which advertising is likely to generate greater dissemination and reach through social networks and web platforms. Precisely, this paper focuses on Resolution No. 0068-2023/SDC-INDECOPI, one of the most recent cases analyzed by the Sala Especializada en Defensa de la Competencia in the telecommunications sector, in which an internet service company accuses one of its competitors of acts contrary to good and fair competition that would have been carried out through its advertising campaign. Based on this, a legal analysis will be made of the alleged infringements related to acts of deception, acts of denigration and violation of the principle of legality that are mainly denounced in the case in order to finally determine whether the Sala should have decided whether or not the alleged facts were founded or not.
