Informe Jurídico sobre la Resolución N° 0743-2024/SPC-INDECOPI: la responsabilidad solidaria de las personas que ejercen cargos gerenciales de empresas proveedoras de productos o servicios inmobiliarios

Abstract

El presente informe jurídico analiza la Resolución N° 0743-2024/SPC-INDECOPI, mediante la cual la Sala Especializada en Protección al Consumidor resolvió imputar responsabilidad solidaria al gerente general de un proveedor de servicios inmobiliarios, aplicando de manera indebida el artículo 111 del Código de Protección y Defensa del Consumidor. De este procedimiento en materia de consumo, surgen temas y conceptos propios del Derecho Administrativo, tales como las garantías y principios que regulan y limitan la potestad sancionadora del Estado. En tal sentido, el análisis parte de un desarrollo teórico de estos principios para explicar de qué manera la Sala Especializada en Protección al Consumidor ha vulnerado el contenido esencial de los mismos al no haber realizado el análisis previo de la gravedad de la infracción; la determinación de un nexo causal entre la supuesta omisión y la infracción cometida por la inmobiliaria; y, no haber motivado de manera suficiente las razones por las que decidió variar el criterio interpretativo del artículo 111 del Código. En atención a ello, el informe jurídico concluye que la Sala no debió imputar responsabilidad solidaria al gerente general por, supuestamente, haber participado en la infracción al Código cometida por el proveedor de servicios inmobiliarios.

This legal report analyzes Resolution N° 0743-2024/SPC-INDECOPI, in which the Specialized Consumer Protection Chamber resolved to attribute joint and several liability to the general manager of a real estate company, improperly applying article 111 of the Consumer Protection and Defense Code. From this consumer proceeding, emerge concepts and topics inherent to Administrative Law, specifically the guarantees and principles that regulate and limit the State's sanctioning power. In this regard, the analysis begins with a theoretical development of these principles to explain how the Specialized Consumer Protection Chamber has violated their essential content by failing to conduct a prior analysis of the infraction's severity; not establishing a nexus between the alleged omission and the infraction committed by the real estate company; and not sufficiently motivating the reasons for changing the interpretative criteria of article 111 of the Code. Accordingly, the legal report concludes that the Chamber should not have attributed joint and several liability to the general manager for allegedly participating in the Code violation committed by the real estate company.
