Abstract
El presente trabajo pretende analizar la sentencia de vista recaída en el Expediente N° 09830-
2019-0-1801-JR-LA-08, mediante la cual se declaró fundada la demanda de nulidad de despido
interpuesta por la señora Ana Verónica Quispe Cardeña contra la empresa Gloria S.A.,
ordenando su reposición en empleo al haberse configurado la causal regulada en el inciso e)
del artículo 29° del Decreto Supremo N° 003-97-TR. En ese sentido, y al haber sido el motivo
por el cual la empresa procedió con el despido la falta grave de impuntualidad reiterada
regulada en el inciso h) del artículo 25° del Decreto Supremo N° 003-97-TR, el objetivo del
informe es analizar si se configuraron los elementos necesarios para la configuración de la falta
grave, así como la aplicación de la protección otorgada por el ordenamiento jurídico peruano a
las madres trabajadoras en el caso concreto. Así, las principales conclusiones del presente
trabajo son que no se configuró la falta grave de tardanzas reiteradas, en la medida que la
sanción del despido no cumplía con los principios de razonabilidad y proporcionalidad.
Asimismo, el empleador no pudo acreditar una causa justa de despido, por lo que se configuró
el despido nulo regulado en el inciso e) del artículo 29° del Decreto Supremo N° 003-97-TR.
The present work intends to analyze the hearing sentence issued in File No. 09830-2019-0- 1801-JR-LA-08, through which the claim for annulment of dismissal filed by Mrs. Ana Verónica Quispe Cardeña against the company Gloria S.A., ordering its reinstatement in employment as the cause regulated in subsection e) of article 29 of Supreme Decree No. 003- 97-TR has been configured. In this sense, and since the reason for which the company proceeded with the dismissal was the serious lack of repeated lateness regulated in subparagraph h) of article 25 of Supreme Decree No. 003-97-TR, the objective of the report is to analyze if the necessary elements were configured for the configuration of the serious offense, as well as the application of the protection granted by the Peruvian legal system to working mothers in the specific case. Thus, the main conclusions of this work are that the serious fault of repeated tardiness was not configured, to the extent that the dismissal sanction did not comply with the principles of reasonableness and proportionality. Likewise, the employer could not prove a just cause for dismissal, for which the null dismissal regulated in subsection e) of article 29 of Supreme Decree No. 003-97-TR was configured
