Abstract
En este trabajo se analiza la Resolución 0037-2021/SDC- INDECOPI que
confirmó la sanción a la Empresa Editora El Comercio S.A (en adelante, El
Comercio) y Amauta Impresiones Comerciales S.A.C (en adelante, Amauta) por
la comisión de la conducta anticompetitiva de reparto concertado de clientes en
el mercado de impresiones comerciales a nivel nacional. Sin embargo, este
ensayo no se centra en el análisis de la conducta anticompetitiva, como se logra
probar la comisión de la misma o la multa impuesta por Indecopi; sino que se
enfoca especialmente en analizar la medida correctiva dictada por la Comisión
consistente en implementar un programa de cumplimiento en materia de libre
competencia.
En atención a ello, se estudia cada uno de los elementos del programa de
cumplimiento dictado y se cuestionan a la luz de los principios del compliance
para finalmente analizar si el programa de cumplimiento dictado cuando con los
elementos mínimos necesarios para evitar que las empresas sancionadas no
vuelvan a realizar prácticas anticompetitivas en el mercado y si resultan
proporcionales.
This paper analyzes Resolution 0037-2021/SDC-INDECOPI, which confirmed the sanction imposed on Empresa Editora El Comercio S.A (hereinafter, El Comercio) and Amauta Impresiones Comerciales S.A.C (hereinafter, Amauta) for the commission of the anti-competitive conduct of concerted distribution of clients in the commercial printing market at the national level. However, this essay does not focus on the analysis of the anti-competitive conduct, how the commission of the same or the fine imposed by Indecopi is proven; but rather it focuses especially on analyzing the corrective measure dictated by the Commission consisting of implementing a compliance program in the area of free competition. In light of this, each of the elements of the compliance program issued is studied and questioned in light of the principles of compliance to finally analyze whether the compliance program issued when with the minimum elements necessary to prevent the sanctioned companies from carrying out anti-competitive practices in the market again and if they are proportional.
