Resumen
El presente informe jurídico tiene por finalidad analizar la controversia que nace
al momento de determinar si una empresa privada cumple con su obligación de
elaborar el Expediente Técnico en el marco de un contrato bajo la modalidad
concurso oferta y sistema a suma alzada a pesar de la existencia de un
incremento económico que no estaba contemplado inicialmente para la
ejecución de obra.
¿Qué sucede cuando el incremento del monto incide directamente en la
prestación de ejecución de obra, más no en la elaboración de ET? En el presente
caso se demostrará que el análisis del cumplimiento de ambas prestaciones
debe realizarse de manera independiente, es decir, atendiendo a su naturaleza
jurídica propia.
Asimismo, se probará que el aumento del presupuesto ofertado resultaba ser la
única solución viable para garantizar una estructura segura y funcional de la
obra. También se analizará cómo se ha establecido la gestión de riesgos en los
contratos bajo la modalidad concurso oferta y sistema a suma alzada.
Finalmente, a la luz de la LCE y el RLCE, se demostrará que la decisión de no
emitir conformidad del ET no fue llevaba a cabo conforme a los parámetros
establecidos, careciendo de sustento objetivo. Todo ello, para concluir que en el
presente caso el contratista cumplió con la elaboración del ET en el marco de
contratación sobre el cual se suscribió.
The purpose of this legal report is to analyze the controversy that arises at the moment of determining whether a private company complies with its obligation to prepare the Technical File in the framework of a contract under the lump sum 2 bidding system despite the existence of an economic increase that was not initially contemplated for the execution of the work. ¿What happens when the increase in the amount directly affects the performance of the work, but not the preparation of the Technical File? In the present case it will be shown that the analysis of the compliance of both services must be carried out independently, that is to say, according to their own legal nature. Likewise, it will be proven that the increase of the tendered budget was the only viable solution to guarantee a safe and functional structure of the work. It will also be analyzed how risk management has been established in the contracts under the competitive bidding and lump sum system. Finally, in light of the LCE and the RLCE, it will be demonstrated that the decision of not issuing conformity of the TF was not carried out according to the established parameters, lacking objective support. All this, to conclude that in the present case the contractor complied with the elaboration of the TF in the contracting framework on which it was subscribed.
