Abstract
El objetivo principal de la presente tesis es analizar las brechas que existen entre los
plazos y costos reales frente a los establecidos por ley en la provincia del Santa, ubicada en el
departamento de Ancash, para los cinco aspectos vinculados a la facilidad de hacer negocios
de acuerdo con la metodología denominada Doing Business del Banco Mundial: registro de
propiedad, obtención de electricidad, cumplimiento de contratos, apertura de empresas y
permiso de construcción, para finalmente desarrollar conclusiones y recomendaciones que
ayuden a mejorar el marco regulatorio de la ciudad, lo que resulta vital para generar un sector
privado próspero, que impacte en el desarrollo económico general del país.
La tesis consta de cinco capítulos: en el primero, se desarrolló una introducción; el
segundo corresponde a la revisión de la literatura; el tercero, a la metodología del estudio; en
el cuarto, se muestra un análisis de los resultados; y el quinto presenta las conclusiones y
recomendaciones.
La recopilación de datos estuvo basada en entrevistas personales que se realizaron en
los distritos de Chimbote y Nuevo Chimbote a expertos involucrados en el sector de la
pequeña y mediana empresa, estos fueron autoridades municipales, abogados, notarios,
empresarios y funcionarios de empresas de distribución de energía.
Esta tesis servirá como instrumento de consulta para el aparato público y privado, a
fin de mejorar las regulaciones asociadas a la vida real de una empresa, en cada una de las
instituciones clave que administran. Así mismo, la investigación tiene un enfoque
cuantitativo de alcance descriptivo y de diseño no experimental del tipo transeccional.
Luego del análisis de los resultados se identificó que los pilares que no presentan
brechas; es decir, cuyos costos y tiempos reales coinciden con lo establecido en la norma son
a) obtención de electricidad, b) registro de propiedad y c) cumplimiento de contratos; sin
embargo, en este último existe una oportunidad de mejora considerando la calificación del
índice de calidad de los procesos judiciales.
Por lo tanto, se recomienda implementar las mejoras específicas asociadas a cada pilar
considerando el uso de las tecnologías de información como herramienta para mejorar la
agilidad de los procesos, reducir los costos y amplificar el alcance a los usuarios. Además se
recomienda destacar las oportunidades para difundir a la provincia de Santa como una ciudad
atractiva para hacer negocios debido a que cuenta con mejores procesos para la apertura de
una empresa en comparación a Lima
The main goal of the following thesis is to analyze the existing gaps between the real terms and costs against those established by regulations in the province of Santa, located in the Department of Ancash for the five aspects related to the easiness for performing trading activities according to methodology called Doing Business, by The World Bank: property registration, electricity procurement, contract fulfillment, business start-up and construction permit, to finally develop conclusions and recommendations to help improve the city's regulatory framework, which is vital for generating a prosperous private sector that creates an impact in the general economic development of the country. This thesis is divided into five chapters: the first chapter is an introduction to the thesis; the second chapter consists of literature review; the third chapter covers the methodology of the study; the fourth chapter shows an analysis of the results; and the conclusions and recommendations are explained in the fifth chapter. Data collection consisted on personal interviews conducted in the districts of Chimbote and Nuevo Chimbote with experts involved in the small and medium-sized enterprise sector: municipal authorities, lawyers, notaries, businessmen and managers of Energy distribution companies. This thesis will be a useful query tool for the public and private apparatus, in order to improve the regulations associated with the real life of a company, in each of the key institutions that they manage. Likewise, the research has a descriptive scope quantitative approach and transectional non-experimental design. After analyzing the results, was identified that the pillars that don’t have gaps have; that is to say, wich actual costs and times are in line with the established in the norm are a) electricity procurement, b) property registration and c) contract fulfillment, though in the latter there is an opportunity for improvement considering the qualification of the quality index of judicial processes. Consequently, is recommended to implement the specific improvements associated with each pillar considering the use of information technologies as a tool to improve the agility of processes, reduce costs and amplify the reach to users. Is also recommended to highlight the opportunities to spread the province of Santa as an attractive city to do business because it has better processes for the business star-up compared to Lima
