Resumen
El presente informe se desarrolla en el contexto de un Procedimiento
Administrativo Sancionador iniciado a la empresa Petrotal por una serie de
incidentes ambientales. A lo largo de este trabajo se discute la definición de daño
ambiental (real y potencial) en el ordenamiento peruano, su falta de umbrales
para determinar las magnitudes de los impactos ambientales y los problemas
que genera al momento de aplicar sanciones. Para este análisis se han utilizado
tanto fuentes bibliográficas doctrinales para el desarrollo de conceptos
ambientales, como fuentes bibliográficas de jurisprudencia del OEFA para
analizar a profundidad los elementos de su línea argumentativa. En virtud de lo
anterior, se determina que la pobre definición de daño ambiental no solo presenta
un problema grave en nuestra legislación que se arrastra a lo largo de los
distintos aspectos de la actividad supervisora y sancionadora de la
administración, pero también conlleva a una imposibilidad de multar a Petrotal
por los hechos imputados.
This report was developed in the context of an administrative sanctioning proceeding initiated against Petrotal for a series of environmental incidents. Throughout this paper, we discuss the definition of environmental damage (actual and potential) in the Peruvian legal system and its lack of thresholds to determine the magnitude of environmental impacts, which creates problems when applying sanctions. To conduct this analysis, we used doctrinal and bibliographic sources to develop environmental concepts, as well as OEFA jurisprudence sources to analyze the elements of its line of argumentation in depth. Based on this analysis, we conclude that the inadequate definition of environmental damage poses a significant challenge in our legislation, affecting various aspects of the supervisory and sanctioning activities of the administration. Furthermore, it renders it impossible to fine Petrotal for the alleged offenses.
