Resumen
El presente informe jurídico analiza la Resolución N.º 006-2012-TSC/66-2012-
TSC-OSINERGMIN, emitida por el Tribunal de Solución de Controversias del
OSINERGMIN, en el marco de una controversia entre Electroperú S.A. y la
Compañía Minera Casapalca S.A. El objetivo principal del trabajo es determinar
si dicha resolución se encuentra debidamente fundamentada en cuanto a la
competencia del Tribunal para pronunciarse sobre la obligación de pago
derivada de los informes de valorización emitidos por el COES. Para ello, se
examina la naturaleza jurídica del COES, el carácter de los informes de
valorización como actos administrativos, y la distinción entre ejecutividad y
ejecutoriedad. Asimismo, se analiza si la controversia corresponde al ámbito
regulatorio o normativo, concluyendo que se trata de una controversia
regulatoria, dado que los informes se elaboran sobre la base de precios
regulados aprobados por OSINERGMIN. El informe sostiene que, si bien el
Tribunal es competente, su razonamiento presenta deficiencias al no desarrollar
adecuadamente la exigibilidad de los actos emitidos por el COES.
This legal report analyzes Resolution No. 006-2012-TSC/66-2012-TSCOSINERGMIN, issued by the Dispute Resolution Tribunal of OSINERGMIN, in the context of a controversy between Electroperú S.A. and Compañía Minera Casapalca S.A. The main objective is to assess whether the Tribunal’s decision is properly grounded regarding its competence to rule on a payment obligation derived from valuation reports issued by COES. The report examines the legal nature of COES, the classification of its valuation reports as administrative acts, and the distinction between executivity and enforceability. It also evaluates whether the dispute is regulatory or normative in nature, concluding that it is regulatory, since the valuation reports are based on regulated prices approved by OSINERGMIN. The report argues that, although the Tribunal is competent, its reasoning is insufficient as it fails to fully justify the enforceability of COES’s acts.
