Resumen
El presente informe analizará la Resolución N° 1990-2013-TC-S1 que emitió la
Primera Sala del Tribunal de Contrataciones, mediante la que declaró fundado
el recurso de reconsideración interpuesto por la empresa contra la resolución
con la que había sido sancionada con trece meses de de suspensión respecto a
su derecho a participar en procesos de selección y/o Contratar con el Estado. Es
así que, principalmente el informe analizará la responsabilidad que podría
atribuirse a la empresa, por haber contratado con la Marina de Guerra del Perú,
a sabiendas de encontrarse impedida dado que tenía como gerente general a un
capitán de fragata en situación de disponibilidad.
Por ello, el informe abordará, en particular, tres aspectos fundamentales. El
primero, en relación a la naturaleza jurídica de un oficial en situación de
disponibilidad de la Marina de Guerra del Perú; el segundo, si el procedimiento
se realizó conforme a la normativa, así como la motivación de las resoluciones
emitidas por el Tribunal; y el tercero, la posible afectación al derecho fundamental
de libertad de contratación.
De manera que, se advertirá que la empresa sí fue responsable de contratar con
la Marina de Guerra, debido a que el vínculo que tenía con la institución, aún
permanecía.
This report will analyze Resolution No. 1990-2013-TC-S1 issued by the First Chamber of the Procurement Tribunal, which declared the reconsideration appeal filed by the company against the resolution with which it had been sanctioned with thirteen months of suspension with respect to its right to participate in selection processes and/or contract with the State to be well founded. Thus, the report will mainly analyze the responsibility that could be attributed to the company for having contracted with the Peruvian Navy, knowing that it was not allowed to do so, given that its general manager was a frigate captain in a situation of availability. Therefore, the report will address, in particular, three fundamental aspects. The first, in relation to the legal nature of an officer on availability status of the Peruvian Navy; the second, whether the procedure was carried out in accordance with the regulations, as well as the motivation of the resolutions issued by the Tribunal; and the third, the possible affectation of the fundamental right of freedom of hiring. Therefore, it will be noted that the company was responsible for contracting with the Navy, since the link it had with the institution still existed.
