Abstract
Este Informe Jurídico desarrolla un análisis relativo a, por un lado, si el
procedimiento administrativo empleado para resolver el caso del señor Vargas y
la señora Orellana fue efectivo, dado que la competencia en primera instancia
fue otorgada a la Comisión N° 2, sin tomar en cuenta la naturaleza y la razón de
ser del procedimiento sumarísimo en materia de consumidor. Por otro lado, se
observa si la sanción pecuniaria aplicada al señor Vargas fue adecuada en
relación al daño causado y la corrección de la conducta infractora.
A efectos de la dilucidación de estos problemas se utilizó doctrina, normativa
vigente a la fecha del caso y normativa actual, jurisprudencia y precedentes
administrativos -resoluciones del OPS N° 1, 2 y 3 de la Sede Lima Sur,
resoluciones de la Comisión de Protección al Consumidor y la Sala Especializada
en Protección al Consumidor-.
This Legal Report develops an analysis regarding, on the one hand, whether the administrative procedure used to resolve the case of Mr. Vargas and Mrs. Orellana was effective, given that jurisdiction in the first instance was granted to Commission No. 2, without taking taking into account the nature and raison d'être of the summary procedure in consumer matters. On the other hand, it is observed if the pecuniary sanction applied to Mr. Vargas was adequate in relation to the damage caused and the correction of the infringing conduct.
