Resumen
El presente informe analiza el Recurso de Nulidad N°350-2021/Lima Sur, mediante el
cual la Corte Suprema revoca la decisión de la Sala Penal que condenó al acusado por
lesiones graves por violencia contra la mujer, reformulándola por el delito de feminicidio
en grado de tentativa. En ese sentido, el problema principal abordado es si la resolución
de la Corte Suprema cumple con los principios de corrección, transparencia, rendición
de cuentas y eficacia del Buen Gobierno.
Para ello, se abordan tres problemas jurídicos. Primero, se analiza si los hechos
suscitados corresponden ser calificados como tentativa de feminicidio y no como
lesiones graves por violencia contra la mujer. Segundo, se desarrolla el feminicidio
tentado como una de las manifestaciones más extremas de violencia de género, así
como la obligación de los jueces y juezas de aplicar el enfoque de género para la
resolución de casos. Por último, se examina si la sentencia de la Corte Suprema
contribuye a fortalecer la confianza de los ciudadanos en el sistema judicial y, así, al
cumplimiento de los principios del Buen Gobierno.
A partir del análisis, se concluye que la decisión de la Corte Suprema corrige
adecuadamente la tipificación del delito, realizando una debida valoración probatoria
con enfoque de género y representando un ejemplo de gobernanza judicial sustantiva.
Por tanto, el presente recurso no solo cumplirá una función reparadora, sino también
una función institucional, dejando sentado un precedente importante que refuerza los
estándares constitucionales en el tratamiento de los casos de violencia de género.
This report analyzes Nullity Appeal N°350-2021/Lima Sur, whereby the Supreme Court revokes the decisión of the Criminal Chamber that convicted the defendant for serious injuries due to violencen violence against women, reformulating it for the crime of attempted feminicide. In this sense, the main problema addressed is whether the Supreme Court’s decisión complies with the principles of correctness, transparency, accountability and effectiveness of Good Governance. To this end, three legal issues are addressed. First, it si analyzed whether the events that took place should be classified as attempted feminicide and not as serious injuries due to violence against women. Second, it develops attempted feminicide as one of the most extreme manifestations of gender violence, as well as the obligation of judges to apply a gender perspective to the resolution of cases. Finally, it is examindes whether the Supreme Court’s ruling contributes to strengthening the confidence of citizenst in the judicial system and, thus, to the fulfillment of the principles of Good Governance. Based on the analysis, it is concluded that the decisión of the Supreme Court’s adequately corrects the criminalization of the crime, making a proper evidentiary assessment with a gender perspective and representing an example of substantive judicial Governance. Therefore, the presen appeal will not only fulfill a restorative function, but also an institutional function, setting an importan precedent that reinforces constitutional standards in the treatment of cases of gender violence.
