Resumen
A raíz de lo señalado en la Convención sobre los Derechos de las Personas con
Discapacidad, en el Perú se ha regulado mediante el Decreto Legislativo N° 1384
y su reglamento, la figura jurídica del apoyo cuya finalidad principalmente es de
asistir a la persona que lo designó para efectos de que pueda interpretar su
voluntad y así pueda ejercer su capacidad jurídica. Asimismo, en lo regulado
destaca la posibilidad de otorgarle facultades de representación al apoyo. Sin
embargo, dicha legislación no ha determinado claramente el registro en el cual
corresponde la inscripción de dichas facultades de representación.
En razón de lo señalado, mediante el presente informe se analiza la Resolución
N° 0930-2024-SUNARP-TR, la cual se resuelve en conformidad con lo aprobado
en el 227° Pleno Registral y se señala que la inscripción de las facultades de
representación del apoyo corresponde sólo en el Registro Personal en vista de
que el precedente de observancia obligatoria aprobado en el 214 Pleno del
Tribunal Registral ha perdido vigencia. Por lo tanto, en el presente se sostendrá
la posición que, en base a un análisis de la legislación señalada y la doctrina,
señala que, en el caso del apoyo con facultades de representación, dichas
facultades deben inscribirse en el Registro de Mandatos y Poderes.
According to the provisions of the Convention on the Rights of Persons with Disabilities, in Peru, Legislative Decree No. 1384 and its regulations regulate the legal concept of support, the primary purpose of which is to assist the person who designated the support so that they can interpret their wishes and thus exercise their legal capacity. Furthermore, the regulations highlight the possibility of granting the support person powers of representation. However, this legislation has not clearly defined the registry in which these powers of representation should be registered. For this reason, this report analyzes Resolution No. 0930-2024-SUNARP-TR, which is resolved in accordance with the provisions of the 227th Plenary Session of the Registry and indicates that the registration of the powers of representation of the support corresponds only to the Personnel Registry, given that the mandatory precedent approved by the 214th Plenary Session of the Registry Court has expired. Therefore, this report will uphold the position that, based on an analysis of the aforementioned legislation and doctrine, indicates that, in the case of support with powers of representation, said powers must be registered in the Registry of Mandates and Powers.
