Informe jurídico sobre la casación N° 876-2020/Cusco: ¿favorecimiento a la prostitución, proxenetismo o trata de personas?

Abstract
En el presente informe jurídico se analiza si la legislación penal vigente permite
identificar de manera correcta los elementos típicos de los delitos contra la
dignidad humana como el favorecimiento a la prostitución, trata de personas, y
proxenetismo; particularmente cuando las víctimas son menores de edad. Para
ello, a partir de la Casación N° 876-2020/Cusco, se evaluará y examinará los
elementos típicos de cada uno de los injustos penales antes mencionados, los
acuerdos plenarios que versan sobre el tema y la forma en la que la Sala Superior
de la Corte Suprema ha ido resolviendo este tipo de controversias en base a la
normativa vigente. De esa manera, se evidenciará que, pese a todos los avances
que se han ido logrando respecto a esta problemática, no existe una delimitación
clara que permita precisar las diferencias que existen entre estos delitos ni
mucho menos como se resuelven los problemas concursales que surgen
cuando, frente a un caso, los hechos planteados pueden ser calificados en más
de un tipo delictivo.
Es así que el caso escogido llega a ser de suma relevancia al ejemplificar los
conflictos que surgen cuando existe un concurso aparente de leyes; así como
los errores en los que puede incurrir la autoridad competente si no contempla la
normativa vigente al momento de emitir sentencia.
This legal report analyzes whether current criminal legislation allows for the correct identification of the typical elements of crimes against human dignity such as favoring prostitution, human trafficking, sexual exploitation and pimping; particularly when the victims are minors. To this end, starting from Cassation No. 876-2020/Cusco, the typical elements of each of the aforementioned criminal offenses, the plenary agreements that deal with the topic and the way in which the Superior Chamber of the Supreme Court has been resolving this type of controversies based on current regulations will be evaluated and examined. In this way, it will be evident that, despite all the progress that has been achieved regarding this problem, there is no clear delimitation that allows specifying the differences that exist between these crimes, much less how the bankruptcy problems that arise when faced with a case, the facts raised can be classified as more than one type of crime. Thus, the chosen case becomes extremely relevant by exemplifying the conflicts that arise when there is an apparent competition of laws; as well as the errors that the competent authority may make if it does not consider the regulations in force at the time of issuing a ruling.
