Resumen
La presente investigación analiza críticamente la aplicación del derecho a probar en los
procedimientos de investigación interna dentro del modelo de prevención peruano, en el
contexto de los estándares internacionales latinoamericanos. El objetivo general es
proponer un marco de actuación que armonice la efectividad investigativa con el respeto
a las garantías procesales fundamentales.
La problemática central radica en la tensión entre la necesidad de conducir
investigaciones internas efectivas y el respeto al derecho fundamental a probar,
particularmente en el sector público donde solo el 47% de las entidades han
implementado canales de denuncia efectivos y únicamente el 23% cuenta con protocolos
específicos para garantizar este derecho.
El método empleado es comparativo, complementado con investigación documental,
análisis de legislación y jurisprudencia, estudio de casos de entidades públicas que han
implementado modelos de prevención, y análisis crítico de la compatibilidad entre
estándares internacionales y normativa peruana.
Como respuesta a esta problemática, la tesis propone un modelo de investigación interna
que busca armonizar las necesidades de compliance con el respeto al debido proceso.
Este modelo, que incluye protocolos y mecanismos de protección, podría servir como
guía para las empresas.
En última instancia, esta investigación no solo contribuye al debate académico sobre el
alcance del derecho a probar, sino que también ofrece soluciones prácticas para un
desafío real y urgente en el ámbito público peruano. Al hacerlo, aspira a fomentar una
cultura de integridad que no sacrifique los derechos individuales en pos de la eficiencia
empresarial.
This research critically analyzes the application of the right to present evidence in internal investigation procedures within the Peruvian prevention model, in the context of Latin American international standards. The general objective is to propose an action framework that harmonizes investigative effectiveness with respect for fundamental procedural guarantees. The central problem lies in the tension between the need to conduct effective internal investigations and respect for the fundamental right to present evidence, particularly in the public sector where only 47% of entities have implemented effective reporting channels and only 23% have specific protocols to guarantee this right. The method employed is comparative, complemented by documentary research, analysis of legislation and jurisprudence, case studies of public entities that have implemented prevention models, and critical analysis of compatibility between international standards and Peruvian regulations. In response to this problem, the thesis proposes an internal investigation model that seeks to harmonize compliance needs with respect for due process. This model, which includes protocols and protection mechanisms, could serve as a guide for companies. Ultimately, this research not only contributes to the academic debate on the scope of the right to present evidence, but also offers practical solutions for a real and urgent challenge in the Peruvian public sphere. In doing so, it aspires to foster a culture of integrity that does not sacrifice individual rights in favor of business efficiency.
