Resumen
En el presente informe jurídico se examina el papel de la administración pública
en la garantía, promoción y protección efectiva de los derechos fundamentales
de las personas con discapacidad, con especial énfasis en aquellas con
discapacidad auditiva dentro del marco de los procedimientos administrativos
vinculados al acceso a la seguridad social. Esta necesidad de análisis surge a
partir de situaciones evidenciadas en diversas entidades del Estado, donde se
observan prácticas normativas y administrativas que podrían constituir formas de
exclusión o discriminación, vulnerando así el principio de igualdad y el acceso
universal a servicios esenciales.
Se analiza el marco constitucional e institucional de SALUDPOL, entidad que, en
su calidad de organismo administrativo estatal, tiene la responsabilidad de
garantizar el acceso equitativo a prestaciones de salud conforme al interés
público y a los principios del Estado social y democrático de derecho. Sin
embargo, se identifican barreras normativas en los reglamentos internos de esa
institución que afectan el desarrollo y bienestar de las personas con
discapacidad auditiva al excluir prestaciones específicas como el acceso a
dispositivos biomédicos fundamentales para su integración social, educativa y
laboral.
Es por ello, que se recurre al marco normativo nacional e internacional sobre
derechos humanos, donde se plantea que las entidades públicas aseguren el
acceso efectivo a la seguridad social respetando el principio de legalidad
y aplicando adecuadamente los principios de buen gobierno, tales
como razonabilidad, sobre la ponderación entre medios y fines y el principio de
eficacia, que detalla la obligación de remover obstáculos que no puedan
garantizar el ejercicio pleno de los derechos.
This legal report examines the role of public administration in ensuring, promoting, and effectively protecting the fundamental rights of persons with disabilities, with particular emphasis on individuals with hearing disabilities, within the framework of administrative procedures related to access to social security. The need for this analysis arises from situations observed in various State institutions, where certain regulatory and administrative practices may constitute forms of exclusion or discrimination, thereby violating the principle of equality and the universal right to access essential services. The report analyzes the constitutional and institutional framework of SALUDPOL, an administrative body of the Peruvian State responsible for guaranteeing equitable access to health services in accordance with the public interest and the principles of the social and democratic rule of law. However, regulatory barriers have been identified within the internal regulations of this institution, which negatively impact the development and well-being of persons with hearing disabilities, particularly through the exclusion of specific benefits such as access to biomedical devices essential for their social, educational, and professional inclusion. Therefore, the analysis turns to both national and international human rights frameworks, asserting that public entities must ensure effective access to social security while respecting the principle of legality and properly applying the principles of good governance, such as the principle of reasonableness, which requires a proportional balance between means and ends, and the principle of effectiveness, which mandates the removal of obstacles that prevent the full exercise of rights.
